影视作品信息网络传播权侵权问题研究

【摘要】：虽然我国的互联网发展起步比较晚,但网络惊人的发展速度已使它不再是新兴事物。互联网是一个没有地域限制、没有时间限制,可以随时随地分享事物的一个平台。当然任何事物发展太快都会出现一些弊端,信息网络虽给公众提供了大量数据,但同时也正在侵犯着一部分公众的权利,比较突出的就是影视作品的侵权行为日益增多。论文针对影视作品这一特殊的作品类型,对其信息网络传播权保护所涉及到的问题进行了系统的阐述。论文的第一部分做为总论,主要解读了信息网络传播权的概念,进而引申出对影视作品信息网络传播权的理解,包括影视作品信息网络传播权的特征、影视作品信息网络传播的形式;论文的第二部分分析侵犯影视作品信息网络传播权的行为模式;论文的第三部分主要从我国的现行法律和司法实践这两个方面阐述了目前存在的问题,具体包括管辖法院确定难、侵犯影视作品信息网络传播权的赔偿标准不合理、对直接侵权的认定具有局限性和难以判定提供搜索、链接主体的主观过错四个方面;论文的第四部分主要针对第三部分我国现存的问题提出了相对应的建议,并从权利人的角度提出如何加强对影视作品著作权的保护措施。
[Abstract]:Although the development of the Internet in our country started relatively late, the amazing speed of the development of the Internet has made it no longer a new thing. A platform where things can be shared anytime and anywhere. Of course, there are some drawbacks to anything that grows too fast. The information network, while providing the public with a lot of data, is also infringing on some of the public's rights. More prominent is the increasing number of violations of film and television works. The first part of the paper, as a general theory, mainly interprets the concept of the right of information network communication, and then extends the understanding of the right of information network communication of film and television works. The second part of the paper analyzes the behavior mode of infringing upon the right of information network communication of film and television works. The third part of the paper mainly from the current law and judicial practice of the two aspects of the current problems, including the jurisdiction of the court to determine, violation of the right to film and television works information network dissemination of compensation standards unreasonable, The identification of direct infringement is limited and difficult to judge to provide search, the subjective fault of the main link four aspects; the 4th part of the paper mainly in view of the third part of the existing problems in China put forward the corresponding recommendations, And how to strengthen the protection measures of the copyright of film and television works from the angle of the obligee.
