论互联网金融消费者的权益保护

【摘要】:随着互联网技术和金融业在我国迅速发展,以及广大消费者对金融产品与服务的需求不断增加,互联网金融这一新的金融业态逐渐进入了我们的日常生活。支付宝、余额宝、增值宝、微信支付等互联网金融产品或模式正在潜移默化中改变着人们传统的金融消费习惯。互联网金融如今已经成为互联网时代金融发展的主要方向。互联网金融消费者作为以消费互联网金融产品与服务为主的一类消费群体,是随着互联网金融业务在我国的快速发展而出现的。在互联网金融交易中,因消费载体的虚拟化、数字化,消费者需要面对不同于传统金融产品与服务的消费标的,需要承受更大的风险。当前互联网金融消费者权益受到侵害的现象时有发生。如余额宝等互联网金融类账户被违法盗用、一些新兴的互联网P2P网贷平台崩溃跑路、互联网金融消费者的个人金融信息被泄露、一些互联网金融经营企业有意的隐瞒投资风险并夸大其互联网金融产品的预期收益等。故而随着互联网金融消费者权益受到侵害的现象越来越突出,我国互联网金融消费者的权益保护需要进一步完善。而我国互联网金融消费者的权益保护体系还存在诸多不足。主要表现在:一是立法上相关规定的缺乏;二是社会征信体系不健全;三是互联网金融市场规范机制不完善;四是互联网金融消费者维权途径不顺畅。本文结合现有的相关理论研究与实践操作,尝试从互联网金融市场交易相关的基础理论和互联网金融消费者的权益保护现状入手,就如何完善互联网金融消费者的权益保护进行相关论述,并提出一些完善建议。这些建议可以概括为:一是制定并完善互联网金融消费者的权益保护相关的法律法规与制度;二是健全我国社会征信体系;三是设立一个专门的互联网金融市场监管机构,完善互联网金融监管体制;四是建立新型的在线纠纷解决机制;五是加强对互联网金融消费者相关知识的宣传教育,重视对互联网金融消费者的权益保护。
[Abstract]:With the rapid development of Internet technology and finance in China, and the increasing demand of consumers for financial products and services, the new financial format of Internet finance has gradually entered our daily life. Alipay, Yu'e Bao, Value-added treasure, WeChat Pay and other Internet financial products or models are changing people's traditional financial consumption habits. Internet finance has become the main direction of financial development in the Internet era. Internet financial consumption. As a class of consumer groups that mainly consume Internet financial products and services, With the rapid development of Internet financial business in China, because of the virtualization and digitization of consumer carriers, consumers have to face different consumer targets from traditional financial products and services in Internet financial transactions. Need to take greater risks. The current phenomenon of Internet financial consumers' rights and interests has occurred from time to time. Internet financial accounts such as Yu'e Bao have been illegally embezzled, and some new Internet P2P network loan platforms have collapsed and run away. The personal financial information of Internet financial consumers has been leaked. Some Internet financial enterprises deliberately conceal investment risks and exaggerate the expected income of their Internet financial products. Therefore, as the rights and interests of Internet financial consumers are violated, the phenomenon is becoming more and more prominent. The protection of the rights and interests of Internet financial consumers in China needs to be further improved. However, there are still many shortcomings in the system of protecting the rights and interests of Internet financial consumers in China. Second, the social credit system is not perfect; third, the normative mechanism of the Internet financial market is not perfect; fourth, the path of safeguarding the rights of Internet financial consumers is not smooth. This paper attempts to discuss how to improve the protection of Internet financial consumers' rights and interests from the basic theory of Internet financial market transaction and the current situation of Internet financial consumers' rights and interests protection. These suggestions can be summarized as follows: first, to formulate and perfect the laws, regulations and systems related to the protection of the rights and interests of Internet financial consumers; second, to improve our social credit system; Third, to establish a special supervision agency for the Internet financial market, and to perfect the Internet financial supervision system; fourth, to establish a new online dispute resolution mechanism; and fifth, to strengthen the publicity and education on the relevant knowledge of Internet financial consumers. Attention should be paid to the protection of the rights and interests of Internet financial consumers.
