中超联赛的法律性质研究

【摘要】:通过考证中超联赛的历史沿革、经营机制、赛事特征及其法律属性,剖析了中超联赛赛事表演服务"产品说"与"作品说"的法理缺陷及其对中超联赛法律保护的不利影响,从《著作权法》视角界定中超联赛属于一种商品性表演服务活动。基于以上认识,进一步阐释中超联赛表演服务活动的价值及其市场供方主体权益,在市场供应主体中:国际足协理事会、中国足球协会分别享有中超联赛作品表演权,而中超联赛俱乐部、中超联赛运动员拥有中超联赛表演者权,中超公司拥有服务经营权,由此从法理上厘清中超联赛的各种收益归属。
[Abstract]:Based on the textual research on the history, management mechanism, competition characteristics and legal attributes of the Super League, this paper analyzes the legal defects of the "product theory" and "work theory" of the performance service of the Chinese Super League and its negative impact on the legal protection of the Super League. From the perspective of copyright Law, this paper defines the Chinese Super League as a kind of commercial performance service activity. Based on the above understanding, this paper further explains the value of the performance service activity and the rights and interests of the market supplier. In the market supply main body: the International Football Association Council, the China Football Association respectively has the Chinese Super League league work performance right, while the Chinese Super League club, the Chinese Super League player has the Chinese Super League performer right, the Chinese Super League company has the service management right, From this legal theory to clarify the super-league in all kinds of income attribution.
