我国农村妇女土地权益被侵害问题研究

【摘要】：中国是农业大国,据第六次人口普查统计,中国农民总数量约六亿七千万,占人口总数的50.32%,而土地是我国六亿七千万农民的生活之根,立命之本。土地问题是中国农村社会问题的根本所在,更是农村妇女问题妥善处理的关键。近年来,由于我国农村经济的快速发展和农村城市化进程的逐渐加快,很多农村家庭中的男性外出到城市打工,让妇女留守农村,农村妇女成为了农村中农业劳作的骨干力量,这种现象造成农村妇女生产生活中对土地的依赖性加强。如何保护农村妇女土地权益问题就显得更为重要。本文分四个部分进行论述。第一部分是我国农村妇女土地权益的概述,阐述了我国农村妇女土地权益的基本含义和主要特征。农村妇女的土地权益,除了具备是绝对权、具有支配性、排他性的土地权益一般特征之外,根据农村妇女这一特殊群体的特性,还具有财产性、保障性、基础性和不稳定性的特征。第二部分描述了我国农村妇女土地权益遭到侵害的现状,随着婚姻关系的变化,列举实践中农村妇女土地权益常受到侵害的六个方面。第三部分从立法、执法、社会原因、农村妇女自身原因等六个方面展开,对我国农村妇女土地权益被侵害的原因进行分析。第四部分基于之前的原因分析,针对性提出完善我国农村妇女土地权益保护制度的对策,包括立法、司法、执法、提高妇女自身素质及法律意识等方面提出了一些合理化建议。
[Abstract]:China is a large agricultural country. According to the 6th census, the total number of Chinese farmers is about 670 million, accounting for 50.32 percent of the total population, and the land is the root of the life of 670 million farmers in China. The land problem is the root of China's rural social problems and the key to proper handling of rural women's problems. In recent years, due to the rapid development of the rural economy and the gradual acceleration of the rural urbanization process in China, Many men from rural families went out to work in cities, leaving women in the countryside. Rural women became the backbone of agricultural work in rural areas. This phenomenon causes the rural women to rely on the land in their production and life. How to protect the rural women's land rights is more important. This paper is divided into four parts. The first part is the rural women in China. An overview of land interests, This paper expounds the basic meaning and main characteristics of rural women's land rights and interests in China. Besides the general characteristics of land rights and interests of rural women, they have the characteristics of absolute right, dominance and exclusiveness. According to the characteristics of this special group of rural women, they also have the characteristics of property, security, foundation and instability. The second part describes the present situation that the land rights and interests of rural women have been infringed upon in our country, with the change of marriage relationship, Enumerate the six aspects in practice in which rural women's land rights and interests are often violated. The third part starts from six aspects, such as legislation, law enforcement, social reasons, rural women's own reasons, and so on. This paper analyzes the causes of the violation of rural women's land rights and interests in China. 4th, based on the previous analysis, the author puts forward countermeasures to improve the system of land rights and interests protection of rural women in China, including legislation, judicature, law enforcement, Some reasonable suggestions are put forward to improve women's own quality and legal consciousness.
