民间文学艺术表达之经济权利保护探索

【摘要】：民间文学艺术表达是文化多样性的体现,具有重要的价值。民间文学艺术表达的商业化利用应当尊重该表达主体的精神权利,利用所获得的经济利益也应当回馈其主体。我国正研究制定《民间文学艺术作品著作权保护条例》,其中“民间文学艺术作品”的概念等同于本文所称“民间文学艺术表达”。已有的许多研究或同等看待权利人的精神权利和经济权利,或者更注重前者;而越来越多的现实情况表明,经济权利才是民间文学艺术表达保护制度建设的核心问题,切实保护好权利人经济利益对于传承、弘扬和发展民间文学艺术表达具有非常重要的作用。本文结合国内外有关研究情况,针对《民间文学艺术作品著作权保护条例(草案)》关于经济权利的规定进行了细致研究,指出其中存在的不妥之处并分析了原因,同时从我国民间文学艺术表达保护的现状出发提出了具体的完善建议:即建立以备案公示制度为中心、以健全权利行使组织和完善授权途径为方法、以法定许可和合理利用为补充的保护体系,以求切实保护民间文学艺术表达权利人的经济利益。本文共四个部分:第一部分主要介绍了民间文学艺术表达概念及关系、保护民间文学艺术表达的理由、追求目标和发展方向,引出保护民间文学艺术表达的必要性;第二部分主要介绍了《民间文学艺术作品著作权保护条例(草案)》的概况,包括机制探索、立法进程、制度设计、核心问题等,聚焦于民间文学艺术表达经济权利的保护;第三部分主要结合条款规定和现实情况深入分析了《民间文学艺术作品著作权保护条例(草案)》存在的不妥之处和问题,包括授权机制不完善、惠益分享规定不明确、限制与例外条件不严谨等,这些问题都可能造成民间文学艺术表达的非合理使用,从而损害权利人经济利益;第四部分是在之前分析的基础之上提出保护民间文学艺术表达经济权利的建议,包括完善行使权利的组织、确定各类授权的关系、加强备案公示制度以及规范限制与例外的情况等。
[Abstract]:Folk literature and art expression is the embodiment of cultural diversity and has important value. The commercial use of folk literature and art expression should respect the spiritual rights of the subject. Our country is studying the regulations on the copyright Protection of Folk Literature and Art works, in which the concept of "folklore works" is equivalent to that of "folklore". Artistic expression "... many studies or equal treatment of the spiritual and economic rights of the right holder have been made, Or pay more attention to the former; and more and more reality shows that economic rights are the core issues in the construction of the protection system for folklore and art expression, and that the economic interests of the right holders should be effectively protected for inheritance. In this paper, the regulations on the Protection of copyright of Folk Literature and Art works (draft) are studied in detail according to the relevant research situation at home and abroad. This paper points out the inappropriateness and analyzes the reasons. At the same time, it puts forward some concrete suggestions on how to protect the expression of folk literature and art in our country: that is, to set up the system of filing and publicizing as the center. To improve the organization of the exercise of rights and improve the means of authorization, with legal permission and reasonable utilization as a supplement to the protection system, In order to protect the economic interests of the right holders of folk literature and art expression, this paper consists of four parts: the first part mainly introduces the concept and relationship of folk literature and art expression, and the reasons for protecting the expression of folk literature and art. The second part mainly introduces the general situation of the regulations on the copyright Protection of Folk Literature and Art works (draft), including mechanism exploration, legislative process, system design. The core issues focus on the protection of the economic rights of folk literature and art expression; The third part mainly analyzes the defects and problems existing in the regulations on copyright Protection of Folk Literature and Art works (draft), including imperfect authorization mechanism and unclear provisions on benefit-sharing. The restrictions and exceptions are not strict, these problems may lead to the irrational use of folk literature and art expression, thereby harming the economic interests of the obligee; The fourth part is based on the previous analysis of the protection of the economic rights of folklore and art, including the improvement of the organization of the exercise of the right to determine the relationship between various types of authorization. Strengthen the record-keeping and publicity system as well as normative restrictions and exceptions and so on.
