有毒物质侵权的因果关系分析

【摘要】：当前有毒物质侵权问题颇受关注,分析其因果关系是为了确定侵权责任主体以及责任范围。由于有毒物质侵权有其特征性,如隐蔽性、持续性等,这就使该类型诉讼的因果关系分析比一般的传统侵权诉讼更加复杂困难。在有毒物质侵权的认定过程中,需要利用科学理论知识,比如医学上的病理分析知识对事实因果关系进行剖析,因此要辨别其中的因果关系显得尤为困难。我国侵权法应当对有关理论及其适用科学证据和科学方法的方面有所考虑。
[Abstract]:At present, the problem of the tort of toxic substances has attracted much attention. The causality analysis is to determine the subject of tort liability and the scope of liability. Because the tort of toxic substances has its own characteristics, such as concealment, persistence, etc. This makes the causality analysis of this type of action more complicated than that of the traditional tort litigation. In the process of determining the infringement of toxic substances, we need to make use of scientific theoretical knowledge. For example, the knowledge of pathological analysis in medicine analyzes the causality of facts, so it is very difficult to distinguish the causality among them. The tort law of our country should consider the relevant theories and the application of scientific evidence and scientific methods.
