【摘要】：虚拟空间中的个人隐私保护是近年来隐私权保护的热点问题之一,但现阶段对其所进行的保护基本上都是从信息隐私权的角度,以规制网络环境中个人隐私信息的传播为重点。而本文则试图以空间隐私权的角度探讨虚拟空间内的隐私保护问题。传统空间隐私权的“空间”并不以物质属性为必要条件,其内涵是人格权法上具有人格利益的空间。从隐私权赖以存在的人格尊严理论的视角,权利人有权追求在虚拟空间中“独处”的状态以及精神上的安宁,以此证实虚拟空间隐私权理论的合理性。然后通过虚拟空间隐私权与传统信息隐私权、网络隐私权的异同点比较,得出虚拟空间隐私权存在的现实合理性。除引言和结语外,共分为五个部分:第一部分,介绍信息隐私权与空间隐私权的划分。本部分以隐私权法上“空间”的人格属性为出发点,论述隐私权法上的私人领域与隐私空间的界定不受物理属性所制约,同时通过对虚拟空间特征的研究,证明虚拟环境下的虚拟空间也应受到空间隐私权的法律保护。第二部分,研究虚拟空间隐私权的基本理论问题。从主体、客体、内容等角度深入剖析了虚拟空间隐私权的内涵,之后借鉴美国法上“合理隐私期待利益”将虚拟空间的保护范围予以明确。最后对虚拟空间隐私权保护范围应受到的合理限制予以说明,从而全方位地展现虚拟空间隐私权的基本面貌。第三部分,结合常见的虚拟空间,将侵犯虚拟空间隐私权的行为进行类型化研究。侵犯虚拟空间隐私权的行为具体可分为侵入、窥探、妨扰、更改、删除、关闭虚拟空间等行为。第四部分,通过介绍被视为欧盟相关信息立法的基础架构之《欧洲议会和理事会保护个人信息处理权益以及促进个人信息自由流通条例草案》所带来个人隐私领域的新变化,对虚拟空间隐私权所包含的权利内容进行探讨,具体从获取权、可携权、拒绝权、被遗忘权等权利考察虚拟空间隐私权的权能内容。第五部分,通过分析现阶段虚拟空间个人隐私权的保护状况,指出我国现行法制框架关于虚拟空间领域的隐私权立法滞后,不能适应时代要求。同时针对传统信息隐私权、网络隐私权对虚拟空间隐私进行保护的不足之处,提出合理化方案及对策:包括承认虚拟空间隐私权的法律地位、抵御来自公权力的侵犯、明确网络服务提供者的义务、设立相对独立的隐私保护执行机构、完善空间隐私权侵权救济等方式。
[Abstract]:The protection of personal privacy in virtual space is one of the hot issues of privacy protection in recent years, but the present stage to protect its are basically from the perspective of information privacy, to the dissemination of personal privacy information regulation in the network environment as the focus.
