结建防空地下室的归属和利用研究

【摘要】：本论文研究的是结建防空地下室的产权归属和利用维护责任分担问题,主要从以下几方面进行研讨:一是通过资料分析对比等方法,提炼出我国现阶段的结建防空地下室建设已经从要数量向要质量转变的观点,由此提出为何我们已无法回避结建防空地下室的权属及利用维护问题;二是对现阶段理论和实践中结建防空地下室权属问题的三种主流观点进行分析:即归国家所有论、归开发商所有论及归业主所有论。本论文对比研究了每一种观点背后的法律背景及现实影响,初步提出了本论文的法律研究框架;三是提出了结建防空地下室应当归国家所有的方案。通过案例及法理分析等方法,解释了为什么结建防空地下室归国家所有更符合物权法精神,更适合我国现阶段国情。此外,通过具体的实验结果,提出了如何在技术和政策层面实现由国家监督,利用人和管理人具体开展结建防空地下室的维护和管理;四是在确定结建防空地下室归属之后,提出了政府部门该如何以公权力确保结建防空地下室的有效利用,尤其是如何落实其在使用中的维护管理机制,以保证结建防空地下室的防护功能不被破坏,最终达到本文研究的目的。本论文的主要意义在通过深入了解结建防空地下室的特性,提出我国结建防空地下室国家所有,在此基础上以地方性法规为支点,建立政府监督,直接利用或管理人具体做好维护的管理模式,进一步解决结建防空地下室的权属和使用问题。
[Abstract]:This paper studies the ownership of property rights and the sharing of responsibility for utilizing and maintaining air defense basements, which are mainly discussed in the following aspects: first, through the analysis and comparison of data,This paper abstracts the view that the construction of junction air defense basement in our country has changed from the important quantity to the important quality at the present stage, and puts forward why we can not avoid the ownership and utilization and maintenance of the junction air defense basement.The second is to analyze the three main views of the ownership of air defense basement in theory and practice at the present stage: the theory of belonging to the state, the theory of ownership by the developer and the theory of ownership by the owner.This paper contrasts the legal background and realistic influence of each viewpoint, and puts forward the legal research frame of this paper preliminarily. Third, it puts forward the scheme that the air defense basement should be owned by the state.By means of case study and legal theory analysis, the author explains why it is more in line with the spirit of property law and is more suitable for the present situation of our country to build an air defense basement owned by the state.In addition, through the concrete experimental results, the paper puts forward how to realize the maintenance and management of the junction air defense basement by using the personnel and the manager at the technical and policy level. Fourth, after determining the ownership of the joint air defense basement,This paper puts forward how the government should use public power to ensure the effective use of the junction air defense basement, especially how to implement its maintenance management mechanism in use, so as to ensure that the protective function of the junction air defense basement is not destroyed.Finally, the purpose of this paper is achieved.The main significance of this paper is to find out the characteristics of the joint air defense basement, and put forward the national ownership of the joint air defense basement in our country. On this basis, the local laws and regulations are taken as the fulcrum, and the government supervision is established.The management mode of maintenance should be made use of directly or managed, and the ownership and use of air defense basement should be further solved.
