论我国社区业主自治权的法律保障

【摘要】：现代社会中人类居住环境的变化,让彼此间不相熟悉的人们在其所居住的小区里形成了一个地缘共同体。在这样的居住环境下生活,时间久了人们常会因对物业的管理和使用问题发生矛盾和纠纷,为了避免矛盾的扩大化,建筑物区分所有权制度慢慢的从实践中孕育而生,这么一来,生活在同一小区中的人就能以此制度为基础成立业主自治组织,以自治的方式来解决小区物业管理上的纠纷。我国自《物权法》颁布后,也确立了建筑物区分所有权制度,但是物权法颁布至今,在小区生活和物业管理中所暴露出来的实际问题又告诉我们,以此制度为基础的业主自治在我国小区生活中并没真正的发挥起作用。造成这一结果的影响因素很多,但从积极的一面来看,这使得我国对研究业主自治问题有着紧迫的需求,为这一领域的完善提供了现实条件。论文首先分介绍了业主自治产生的理论渊源,业主自治的含义,解释了业主、业主自治组织等相关概念;其次,阐述了我国业主自治现状及存在的问题,并对存在的问题进行分析;再次,是对业主自治过程中的几类关系给予了厘清,为后续给出相应的确保业主自治权的主张与实现的对策做了铺垫;最后,提出了保障我国业主自治权实现的可行法律对策,即:对现阶段业主自治组织的结构进行优化,提出借鉴美国业主自治制度建立业主团体,以业主团体为中心对我国业主自治制度的运作做进一步的优化。
[Abstract]:The change of human living environment in modern society makes people who are not familiar with each other form a geographical community in the community in which they live.Living in such a living environment, people often have contradictions and disputes because of the management and use of property for a long time. In order to avoid the expansion of contradictions, the system of building condominium is born slowly from practice.In this way, people living in the same community can set up owners' self-governing organization based on this system, and solve the disputes on property management in the way of autonomy.Since the promulgation of the Real right Law, China has also established the system of building division ownership. However, since the promulgation of the property Law, the actual problems exposed in the area life and property management have told us again.The owner autonomy based on this system has not really played a role in the community life in our country.There are many factors that influence this result, but on the positive side, there is an urgent need for the study of owner autonomy in our country, which provides a realistic condition for the perfection of this field.Firstly, the paper introduces the origin of the owner autonomy, the meaning of the owner autonomy, explains the related concepts such as the owner, the owner autonomy organization and so on. Secondly, it expounds the present situation and the existing problems of the owner autonomy in our country.And analyze the existing problems; thirdly, it clarifies several kinds of relationships in the process of owner autonomy, and paves the way for the following to ensure the owner autonomy and the realization of countermeasures; finally,This paper puts forward the feasible legal countermeasures to guarantee the realization of the owner's autonomy in our country, that is, to optimize the structure of the owner's self-governing organization at the present stage, and to set up the owner's group with reference to the American owner's autonomy system.Take the owner group as the center to make further optimization to the operation of the owner autonomy system in our country.
