虚拟发行语境下首次销售原则的法律与经济分析

【摘要】:产生于实体发行领域的首次销售原则是著作权与物权相互妥协的结果,是降低作品传播成本,促进作品传播的必然选择。然而,在虚拟发行模式下,作品的传播与物质的移转相分离,著作权与物权的冲突已经不复存在;而数字文化产品的边际生产成本又趋近零,法律规定首次销售原则不但对降低作品传播成本无益,反而会让读者负担不必要的交易成本和风险,不利于作品的传播。为此,除软件等可用时间度量使用价值消费程度的作品外,首次销售原则不宜作为著作权法定限制事由或相关合同的默认补充规则适用于作品虚拟发行之情形。
[Abstract]:The principle of first sale in the field of entity distribution is the result of the compromise between copyright and real right. It is the inevitable choice to reduce the cost of dissemination of works and to promote the dissemination of works.However, under the mode of virtual distribution, the communication of works is separated from the transfer of material, the conflict between copyright and real right no longer exists, and the marginal production cost of digital cultural products approaches zero.The principle of first sale stipulated by law will not only reduce the cost of dissemination of works, but also make readers bear unnecessary transaction costs and risks, which is not conducive to the dissemination of works.Therefore, except software and other works which can measure the consumption degree of use value, the principle of first sale should not be used as the default supplementary rule of copyright law to restrict the subject matter or the relevant contract.
