航空公司实质所有权和有效控制权的法律研究

【摘要】：随着经济全球化和管制的放松,航空公司实质所有权和有效控制权自由化也成为一种趋势。航空公司实质所有权和有效控制权的存废问题成为焦点。文章从航空公司实质所有权和有效控制权的基本理论出发,结合我国航空公司实质所有权和有效控制权的立法实践,对比外国航空公司实质所有权和有效控制权的立法实践,得出实质所有权和有效控制权存废的结论,并且提出完善的建议,以促进我国航空业从民航大国向民航强国的发展。
[Abstract]:With the economic globalization and deregulation, the liberalization of substantial ownership and effective control of airlines has become a trend.The issue of substantial ownership and effective control of airlines becomes the focus.Based on the basic theory of substantial ownership and effective control of airlines, this paper compares the legislative practice of substantial ownership and effective control of foreign airlines with the legislative practice of substantive ownership and effective control of airlines in China.The paper draws the conclusion that substantive ownership and effective control right are saved or abolished, and puts forward some perfect suggestions to promote the development of China's aviation industry from a large country of civil aviation to a powerful country of civil aviation.
