电子竞技游戏直播的著作权问题研究

【摘要】:伴随着我国近几年电子竞技游戏的火热发展,我国电子竞技游戏直播异军突起,经济效益和规模迅速增长,并积极带动了相关的游戏产业的繁荣。其中,以电子竞技游戏直播最为显著,因游戏直播属于新兴起产业模式,引发了较多的争议与纠纷。现行的著作权法对此亦缺乏相关的规定,使得实务中遇到的大量问题难以有效解决,许多与此相关的版权问题亟待法律法规予以明确。本文首先从现有的市场数据出发,揭示近年电子竞技游戏直播的火爆以及其产业经济效益的规模的基础上,引出对电子竞技游戏直播的著作权保护以及界定等相关问题的必要性与重要性。充分论述认定以动态画面即视频的形式存在的电子竞技游戏直播视频属于著作权法上的作品,在此基础上,从游戏作品本身固定的和临时呈现的内容的角度,对电子竞技游戏直播视频所归属的临时呈现的内容进行著作权法上的作品归类以及相关权利的归属的划分及对游戏玩家的角色与行为进行界定。最后,在充分论述以上问题的基础上,对电子竞技游戏直播的侵权问题进行初步探索和论述,并在最后提出电子竞技游戏直播著作权保护的困境与完善的建议。本文试图通过以上角度对电子竞技游戏直播进行具体分析,希望能对于界定电子竞技游戏直播相关权利和保护提供一些新的思路,促进游戏市场与产业的繁荣发展,同时对于我国知识产权立法的完善提出一些有益的参考与建议。
[Abstract]:With the hot development of electronic competitive games in China in recent years, the direct broadcast of electronic sports games in China has suddenly emerged, the economic efficiency and scale has increased rapidly, and has actively promoted the prosperity of the related game industry.Among them, live broadcast of electronic sports games is the most obvious, because it belongs to the newly emerging industry mode, it has caused more disputes and disputes.Due to the lack of relevant regulations in the current copyright law, a large number of problems encountered in practice are difficult to solve effectively, and many related copyright problems are urgently needed to be clarified by laws and regulations.Based on the existing market data, this paper first reveals the popularity of direct broadcast of electronic competitive games in recent years and the scale of its industrial economic benefits.This paper introduces the necessity and importance of copyright protection and definition of direct broadcast of e-sports games.It is fully discussed that the live video of electronic competitive games in the form of dynamic picture, that is, video, belongs to the works of copyright law. On this basis, from the angle of the fixed and temporary content of the game work itself,In this paper, the author classifies the content of the temporary presentation of the live video of the e-sports game in the copyright law, classifies the relevant rights, and defines the role and behavior of the gamer.Finally, on the basis of fully discussing the above problems, this paper makes a preliminary exploration and discussion on the infringement of direct broadcast of electronic competitive games, and finally puts forward the difficulties and suggestions for the protection of the copyright of live broadcast of electronic sports games.This paper attempts to make a concrete analysis of the direct broadcast of e-sports games from the above angles, hoping to provide some new ideas for defining the rights and protection of direct broadcast of e-sports games, and to promote the prosperity and development of the game market and industry.At the same time, some useful references and suggestions are put forward for the perfection of intellectual property legislation in China.
