交通事故中车辆被挂靠单位责任承担探究

【摘要】：机动车交通事故损害赔偿纠纷中,被挂靠单位应该对挂靠车辆的侵权行为承担什么样的责任一直是理论界和司法实务界争论不休的热点。在最高法院相关司法解释出台以前,各省高级法院以指导意见或座谈会纪要的形式规定被挂靠单位应承担连带责任、补充责任、替代责任等,这造成了司法不统一,不仅不利于定纷止争,还严重影响了法律的权威。本文以笔者处理过的两起交通事故损害赔偿案件入手,着重分析了挂靠的性质、产生原因,并通过“二元说”,即运行支配和运行利益理论来探讨被挂靠单位的责任承担问题。最后,对如何实现各方的利益平衡提出自己的思考。
[Abstract]:In the dispute of motor vehicle traffic accident damage compensation, what kind of liability should be taken by the affiliated unit to the tortious act of the connected vehicle has always been a hot point in the theoretical and judicial circles.Prior to the introduction of the relevant judicial interpretation of the Supreme Court, the provincial high courts, in the form of a guiding opinion or a summary of the symposium, stipulated that the affiliated units should bear joint and several liability, supplementary liability, alternative liability, and so on. This resulted in a lack of unity in the administration of justice.Not only is it not conducive to the resolution of disputes, but also seriously affected the authority of the law.Starting with two cases of compensation for traffic accident damage, this paper analyzes the nature and causes of the link, and discusses the responsibility of the affiliated unit through the theory of "duality", that is, the theory of operation dominating and operating interest.Finally, how to achieve the balance of interests of all parties put forward their own thinking.
