房屋善意次承租人权益保护研究

【摘要】:近年以来,城市化的进程加速,加之房价居高不下,催生了大量的租房群体。在市场需求的推动下,相关交易逐渐频繁,房屋租赁市场蓬勃发展,转租成为一种普遍现象,在经济生活中扮演重要角色。而我国现行立法对转租的规定尚不完善,现有的规定又将视角聚焦于出租人的权利,忽视了对承租人和次承租人的保障。一方面,规定的不完善使得实际生活和司法实践中滋生了许多棘手的问题,相同类型的案件却有不同的审判结果,导致司法的公信力减弱;另一方面,次承租人在租赁关系中处于相对弱势,善意次承租人需要独自承担的风险过高,必然会对房屋转租合同的成立产生不良影响,进而制约市场经济环境下房屋转租市场的稳定和发展以及社会秩序的稳定。此外,次承租人实际利用房屋,对其享有信赖利益,其权益应当受到法律保护。因此,完善相关制度、对次承租人之正当利益进行强化保护十分必要。本文主要运用文献研究法、归纳综合法以及对比研究法,以房屋次承租人的视角为出发点,指出了对其权益保护的立法缺陷,并给出完善房屋善意次承租人权益保护的建议。全文共分为五个部分。第一部分,绪论;第二部分,对房屋租赁相关概念作出了说明,具体认定次承租人的善意,阐述了房屋次承租人的三种主要权利;第三部分,分析了保护房屋转租中的次承租人权益之法理依据;第四部分,对比中外立法对自行转租合同效力、出租人合同解除权的限制性规定以及次承租人具体权利的规定,从转租合同效力定位、对出租人的合同解除权限制以及次承租人权利规范三个角度提出了我国对房屋次承租人权益保护立法的缺陷;第五部分,针对立法中存在的缺陷,借鉴国外相关立法,提出完善我国房屋次承租人权益保护的建议。
[Abstract]:In recent years, the acceleration of urbanization, coupled with high housing prices, gave birth to a large number of rental groups.Driven by the market demand, the related transactions become more and more frequent, the housing rental market is booming, sublease has become a common phenomenon and plays an important role in economic life.However, the current legislation of our country is not perfect, the existing provisions focus on the lessor's rights and neglect the protection of the lessee and sub-lessee.On the one hand, the imperfections of the regulations lead to many thorny problems in real life and judicial practice, while the same types of cases have different trial results, which leads to the weakening of the credibility of the judiciary; on the other hand,The sub-lessee is in a relatively weak position in the lease relationship, and the risk that the sub-lessee needs to bear alone is too high, which will inevitably have a negative impact on the establishment of the housing sublease contract.Furthermore, it restricts the stability and development of housing sublease market and the stability of social order.In addition, the sub-lessee actually uses the house, enjoys the trust interest, its rights and interests should be protected by the law.Therefore, it is necessary to perfect the relevant system and strengthen the protection of the legitimate interests of the sub-lessee.This article mainly uses the literature research method, induces the synthesis method and the contrast research method, takes the housing sub-lessee 's angle of view as the starting point, points out the legislation flaw to its rights and interests protection, and gives the suggestion to perfect the house bona fide sub-lessee 's rights and interests protection.The full text is divided into five parts.The first part, introduction; the second part, to the housing lease related concept has made the explanation, the concrete confirmation sub-lessee 's good will, elaborated the housing sub-lessee 's three kinds of main rights; the third part,This paper analyzes the legal basis of protecting the rights and interests of the sub-lessee in the sublease of the building. The fourth part compares the effectiveness of the domestic and foreign legislation on the sublease contract, the restrictive provisions of the lessor's right to rescind the contract and the specific rights of the sub-lessee.This paper puts forward the defects of the legislation on the protection of the rights and interests of the sub-lessee in our country from the three angles of the orientation of the validity of the sublease contract, the limitation of the right to rescind the contract of the lessor and the regulation of the rights and interests of the sub-lessee.Draw lessons from foreign relevant legislation, put forward the suggestion of perfecting our country house sub-lessee rights and interests protection.
