失独家庭权益法律保障研究

【摘要】：失独家庭目前已经成为一个越来越严重的社会问题并开始引起国家和社会的关注。上世纪70年代末起,为了响应国家的计划生育政策,很多家庭只生育了一个子女。但是现在有一部分这样的家庭中由于子女先于父母的离世成为了失独家庭。失独家庭面临着养老、经济及法律援助困难等诸多问题,而国家现有的救济途径和政府干预都太少。本文从法学理论中的基本人权和弱势群体特殊保护等理论阐述失独家庭权益保护的理论基础。我国失独家庭面临诸多的问题,而我国现在的法律体制、养老体制还很不健全,在这些问题上西方很多国家的已有经验值得我国去学习和借鉴。在本文中,通过对日本的成年人监护制度、美国的法律援助制度、德国的养老保险制度以及英国的社区养老模式的介绍,对我国如何进行失独家庭权益保护有极大的参考价值。最后,针对失独家庭面临的问题,国家可以从完善失独家庭法律保护依据、明确政府执行机构与职能、建立失独家庭的养老制度、法律援助制度及成年人监护制度等角度考虑,为失独家庭建立起立体化的权益保障体系。
[Abstract]:The independence-deprived family has become an increasingly serious social problem and has begun to attract the attention of the country and society. Since the late 1970s, many families have had only one child in response to the country's one-child policy. But now some of these families have lost their families because their children passed away before their parents. Families without independence face many problems, such as pension, economic and legal aid difficulties, but the existing national relief channels and government intervention are too few. This paper expounds the theoretical basis of the protection of the rights and interests of families without independence from the basic human rights and the special protection of vulnerable groups in the theory of law. Our country loses the independence family to face many problems, but our country present legal system, the pension system is still very not perfect, in these questions many western countries already has the experience to be worth our country to study and draw lessons from. In this paper, through the introduction of the adult guardianship system in Japan, the legal aid system in the United States, the endowment insurance system in Germany and the community pension model in Britain, it is of great reference value to protect the rights and interests of families without independence in our country. Finally, in view of the problems faced by families without independence, the state can consider from the angles of perfecting the legal protection basis of families without independence, clarifying the executive organs and functions of the government, establishing the pension system of families without independence, legal aid system and adult guardianship system, etc. To establish a three-dimensional protection system of rights and interests for families without independence.
