死者人格利益保护的理论基础和立法选择

【摘要】：学界对死者人格利益应予以保护已达成共识,但保护的究竟是死者利益、近亲属利益还是社会公共利益,存在不同观点。英美国家和日本采间接保护说,德国和俄罗斯则采直接保护说。我国法律对死者人格利益保护没有明确规定,死者人格利益保护制度的构建完全依赖于司法解释,法院对死者人格利益保护究竟是采直接保护说还是间接保护说摇摆不定。我国未来民法典应以近亲属权益兼顾公共利益保护为理论基础,采间接保护说。
[Abstract]:Scholars have reached a consensus that the interests of the deceased should be protected, but there are different views on whether to protect the interests of the deceased, the interests of the near relatives or the public interests. Anglo-American countries and Japan adopt indirect protection theory, while Germany and Russia adopt direct protection theory. There is no clear stipulation on the protection of the personality interests of the deceased in our law, and the construction of the protection system of the personality interests of the deceased completely depends on judicial interpretation. The court is uncertain about whether the protection of the personality interests of the deceased should adopt the theory of direct protection or indirect protection. The future civil code of our country should take the protection of the public interest as the theoretical basis and adopt the theory of indirect protection.
