云计算环境下的版权问题研究

【摘要】：由于云计算这一技术与服务模式的创新,我们迎来了大数据时代。面对信息领域这一深刻的变革,云计算带来了继计算机、互联网后对版权制度的第三次冲击。但同时云计算技术是对分布式计算技术的一种继承和发展,对版权领域的影响在于作品复制方式的改变,本文认为应采取保守的研究态度,在现有法律法规的基础上出台相应的司法解释细化适用标准,并积极探讨版权授权模式这一主动规制云计算作品传播环境的途径。导论首先介绍了云计算环境下版权制度问题研究的研究背景和意义,在云计算迅速发展之初通过对其版权问题的研究为今后云计算环境下作品保护提供良好的环境。之后介绍了对这一问题的国内外研究现状;第一章具体介绍了云计算的定义、特征、服务模式,了解云计算对版权复制产生的影响;第二章通过对两个临时复制典型案例的介绍引出云计算环境下临时复制问题的争议焦点,之后通过对临时复制行为特点分析阐明其不构成复制权的侵犯,最后在其不纳入复制权保护的前提下,讨论信息网络传播权和出租权是否可以对临时复制行为进行规制;第三章通过对IPTV运营模式的概述引出IPTV“回看”模式这一版权争议问题,之后通过对该模式的详细分析,得出IPTV“回看”模式可以有信息网络传播权加以规制,但因为版权人利益受损并不大且从鼓励技术发展的角度看,提前谈判分享利益是一种共赢之选;第四章通过对第三方插件侵权案件的概述引出两种不同类的插件侵权类型,同时分析云计算环境下第三方插件侵权该如何规制;第五章阐明云计算对版权制度的冲击本质上是作品复制方式的改变,之后从技术中立角度说明法律制度不应过于遏制技术的发展,并积极探寻法律以外的解决途径——版权授权模式。
[Abstract]:Due to cloud computing technology and service model innovation, we ushered in big data era. In the face of this profound change in the field of information, cloud computing has brought the third impact on copyright system after computers and the Internet. But at the same time, cloud computing technology is a kind of inheritance and development of distributed computing technology, and the influence on copyright field lies in the change of the way of reproduction of works. This paper holds that we should adopt a conservative research attitude. On the basis of the existing laws and regulations, the corresponding judicial interpretation is introduced to refine the applicable standards, and actively explore the copyright licensing model, an active way to regulate the cloud computing work dissemination environment. The introduction first introduces the background and significance of the research on copyright system in cloud computing environment. At the beginning of the rapid development of cloud computing, it provides a good environment for the future work protection in cloud computing environment through the study of copyright issues. The first chapter introduces the definition, characteristics, service mode of cloud computing and the impact of cloud computing on copyright replication. In the second chapter, through the introduction of two typical cases of temporary replication, it leads to the controversy focus of temporary replication in cloud computing environment, and then through the analysis of the characteristics of temporary replication behavior, it clarifies that it does not constitute an infringement of replication rights. Finally, on the premise that it does not include the protection of reproduction right, the paper discusses whether the right of information network communication and the right to rent can regulate the temporary reproduction behavior; The third chapter introduces the copyright dispute of IPTV "look back" mode by summarizing the operation mode of IPTV, and then through the detailed analysis of this mode, it concludes that the "back view" mode of IPTV can be regulated by the right of information network transmission. However, because the interests of copyright owners are not seriously damaged and from the perspective of encouraging the development of technology, it is a win-win option to negotiate ahead of time to share the benefits. Chapter four introduces two different types of plug-in infringement through the overview of third-party plug-in infringement cases. At the same time, it analyzes how to regulate the infringement of third-party plug-in under the cloud computing environment. Chapter five clarifies that the impact of cloud computing on copyright system is essentially the change of the way of reproduction of works. Then, from the point of view of technology neutrality, it explains that the legal system should not contain the development of technology too much, and actively explore the solution outside the law-copyright licensing mode.
