专利保险制度研究

【摘要】：随着我国经济转型的需要,专利权的保护显得格外重要。企业越发重视专利技术,伴随而来的是侵权现象越发普遍,同时我国企业进入国外市场遇到不少障碍。与此同时,涉及专利诉讼的主体不确定性、诉讼周期长、费用高昂以及专利的特殊性,导致企业无法生存的现象时有发生。一方面,大企业无法走出国门;另一方面,对于中小企业,一旦遇到专利诉讼,无疑是灭顶之灾。在此背景下,国家积极推动专利保险的发展,制定推进知识产权金融发展的规划,全国试点工作有序进行,争取早日实现科技强国的目标。本文除开引言以及结语共分为四个部分,第一个部分是对专利权及专利保险的发展进行梳理,着重介绍专利权与专利保险,而专利价值是专利权与专利保险的桥梁,专利保险的研究基础就是基于专利权。第二部分是专利保险的理论与现实基础与面临的问题,专利保险制度构建,由于专利的特殊性,专利作为可投保之标的具有重大意义。同时,现阶段的专利问题也对专利保险有重大影响。第三部分是对域外专利保险制度比较研究,分别从美国、英国和日本借鉴学习他们的先进经验。第四部分集中探讨目前我国专利保险制度发展的构想,分别从我国专利保险试点现状改善、政府与保险人角度以及专利价值评估分析,探究我国专利保险制度的发展。
[Abstract]:With the need of economic transformation in China, the protection of patent rights is particularly important. Enterprises pay more and more attention to patent technology, accompanied by the phenomenon of infringement is becoming more and more common, and at the same time, Chinese enterprises encounter many obstacles in entering foreign markets. At the same time, the uncertainty of the subject involved in patent litigation, the long period of litigation, the high cost and the particularity of patent cause the phenomenon that enterprises can not survive from time to time. On the one hand, large enterprises can not go out of the country; on the other hand, for small and medium-sized enterprises, once they encounter patent litigation, it is undoubtedly a disaster. In this context, the state actively promotes the development of patent insurance, formulates a plan to promote the development of intellectual property finance, and carries out the national pilot work in an orderly manner, striving for the early realization of the goal of a powerful country in science and technology. In addition to the introduction and conclusion, this paper is divided into four parts. The first part is to comb the development of patent rights and patent insurance, focusing on patent rights and patent insurance, and patent value is the bridge between patent and patent insurance. The research foundation of patent insurance is based on patent right. The second part is the theoretical and practical basis and problems of patent insurance. The construction of patent insurance system, because of the particularity of patent, patent as the subject of insurable has great significance. At the same time, the current patent issue also has a major impact on patent insurance. The third part is a comparative study of the foreign patent insurance system, learning their advanced experience from the United States, Britain and Japan. The fourth part focuses on the conception of the development of patent insurance system in our country, and probes into the development of patent insurance system of our country from the point of view of government and insurer, the angle of government and insurer, and the evaluation of patent value.
