具有身份性财产权继承问题探究

【摘要】：随着社会发展,新型财产不断涌现,我国继承法中规定的遗产范围面临挑战。文章认为具有身份性的财产权如机动车牌照使用权、手机吉祥号使用权、股东权等权利,只要符合遗产的时间性、特定性、合法性及可转让性等特点,就能成为继承的客体。未来《继承法》修订中关于遗产的范围也应适度扩大。
[Abstract]:With the development of society, new types of property are emerging, and the scope of inheritance law in our country is facing challenges. This paper holds that the property rights with identity, such as the right to use the license plate of the motor vehicle, the right to use the auspicious number of the mobile phone and the right of the shareholders, can become the object of inheritance as long as they accord with the characteristics of the time, specificity, legality and transferability of the inheritance. The scope of inheritance should also be expanded in the future revision of inheritance Law.
