论知识产权权利的动态属性

【摘要】：知识产权与一般的财产所有权不同,虽然具有排他性的特征,但无法通过排他占有而直接实现权利人的利益增长。因此,知识产权制度追逐的首要价值,是以"知识"快速增益并促进"知识"快速流转的效率价值,这使得知识产权的权利具有了动态属性,即只有在知识产权转化的情况下权利人的利益才能得以实现。这意味着知识产权制度应当具有法律激励的重要功能。
[Abstract]:Intellectual property is different from general property ownership, although it has exclusive characteristics, it can not directly realize the benefit growth of the obligee through exclusive possession. Therefore, the most important value pursued by the intellectual property system is the efficiency value of "knowledge" rapid gain and rapid transfer of "knowledge", which makes the intellectual property rights have a dynamic attribute. That is, only in the case of the transformation of intellectual property rights can the interests of the obligee be realized. This means that the intellectual property system should have the important function of legal incentive.
