【摘要】：作为一项古老的法律制度, 《继承法》为继承人的权利保护提供了非常有效的法律依据。但是,我国现行《继承法》1985年颁布,至今已长达30年之久,伴随着社会的发展及家庭成员结构、财产形式的变化,这部诞生于计划经济时代、通篇仅37个条文的法律,在保护继承权的过程中已经越发显得苍白无力,故学界及社会关于修改《继承法》的呼声越来越高。本文中所讨论的继承回复请求权,就是现行《继承法》没有涉足的一项继承权制度,它是继承人在继承权受到他人侵害时所采取的一种法律保护机制,对于这一机制的研究具有深远的意义,本文作者从继承回复请求权的历史沿革、概念、功能、行使及制度完善等多方面对继承回复请求权进行了较为深入的研究,并在最后拟定了相关法律条文,以期对我国未来《继承法》的修改有所裨益。文章主体共包含以下五个部分：第一部分主要是对继承回复请求权进行了系统的概述,首先从继承回复请求权的历史沿革出发,通过追溯这一权利的渊源进而对其概念、功能作进一步的分析,以此来探讨我国未来立法对继承回复请求权的取舍；第二部分主要通过厘清继承回复请求权与其他请求权的关系,进而对这一权利的性质和地位做出更加明晰的界定；第三部分则是通过详细分析继承回复请求权的构成要件,进而从实践出发,明确了这一权利的行使主体、行使方式及行使效力问题。第四部分介绍了大陆法系一些国家和地区有关继承回复请求权的立法概况,通过分析对比各国家和地区相关的法律规定及制度设立,借鉴已有的经验为我国立法完善提供充分的理论依据；第五部分通过对前文继承回复请求权的研究总结,在借鉴其他国家和地区立法模式的同时,结合我国当前的立法状况,对立法缺陷进行反思,并进一步论证了我国设立继承回复请求权的必要性和可行性,最终提出对我国未来相关立法的建议。
[Abstract]:As an ancient legal system, the inheritance law provides a very effective legal basis for the protection of the rights of the successors. However, the current "Inheritance Law" has been promulgated in >1985 for 30 years, with the development of the society and the structure of family members, and the transformation of the form of property, which was born in the era of planned economy, with only 37 chapters. The law of the provisions has become more and more powerless in the process of protecting the right of inheritance, so the voice of the academia and the society on the amendment of the inheritance law is becoming more and more high. The right of the inheritance reply in this article is a system of inheritance, which is not involved in the inheritance law, which is adopted by the successor when the right of inheritance is infringed by others. A legal protection mechanism is of profound significance to the study of this mechanism. The author has made a more in-depth study of the inheritance reply claim right from the historical evolution, concept, function, exercise and system improvement of the right of inheritance reply, and finally drew up relevant legal provisions in order to follow the future of our country. The main body of the article includes the following five parts: the first part is mainly a systematic overview of the right of the inheritance reply request, first of all, starting from the historical evolution of the right of the inheritance reply, through tracing the origin of this right and further analysis of its concept, so as to explore the failure of our country. The second part mainly clarifies the relationship between the right of the inheritance reply and the other claim, and then makes a clearer definition of the nature and status of the right, and the third part is through the detailed analysis of the requisites of the claim of the inheritance reply, and then it is clear from the practice. The fourth part introduces the legislative general situation of the right of the inheritance reply request in some countries and regions of the civil law system, and compares the relevant laws and regulations and systems of various countries and regions by analyzing and comparing the existing experiences to provide sufficient theoretical basis for the perfection of our country's legislation. According to the conclusion of the fifth part, through the research and summary of the right of the previous inheritance and reply, the necessity and feasibility of establishing the right of the inheritance reply in our country are further demonstrated by drawing on the legislative pattern of other countries and regions and combining with the current legislative situation of our country, and the necessity and feasibility of establishing the right of inheritance reply in our country are further demonstrated.
