【摘要】：科技创新是国家发展的核心力量,在提高我国社会生产力和综合国力上具有重要战略地位。维持科技创新的活力则需要加强对知识产权的保护。高校在生产、传播、推广和转化知识与科学技术上起着至关重要的作用,日渐成为知识创新的先锋主导。随着改革的深入和社会的进步,高校人员流动越来越频繁,在人员流动的过程中,造成高校科研成果流失、科研项目终止、知识产权受损、专利转化率低的问题也日益凸现。因此,加强高校人员流动与知识产权的保护,实现高校人员流动与知识产权保护二者的利益平衡,建立一种符合实际的高校人员流动与知识产权保护的双向支撑行为模式,已经成为高校面临的重要课题。本文首先阐明了高校人员流动与知识产权保护的研究背景和重要意义,从而进一步剖析对高校人员流动与知识产权保护工作进行研究的目的和创新点,接着对高校知识产权相关的概念、管理特点和流失的渠道及二者的辩证关系进行了叙述。其次,通过典型案例,分析我国高校知识产权保护的现状,指出现阶段我国高校知识产权保护存在的一系列问题,再结合美国和日本的高校知识产权管理的经验借鉴基础之上得到在管理意识、知识产权归属、相关政策法规体系建立和完善等方面的启示。最后,面对国内高校人员流动的问题,如何做好知识产权保护工作提出了相应的措施和建议,包括对高校知识产权保护意识、组织机构建设、规章制度、流动人员的内部管理及引入“转会制”等。总之,本文着力化解高校人员流动对知识产权保护的不利因素,以促进高校知识产权的保护。
[Abstract]:Scientific and technological innovation is the core force of national development and plays an important strategic role in improving China's social productivity and comprehensive national strength. To maintain the vitality of scientific and technological innovation, we need to strengthen the protection of intellectual property rights. Colleges and universities play a vital role in the production, dissemination, promotion and transformation of knowledge and science and technology, and gradually become the vanguard of knowledge innovation. With the deepening of the reform and the progress of the society, the movement of personnel in colleges and universities is becoming more and more frequent. In the process of personnel mobility, the problems such as the loss of scientific research achievements, the termination of scientific research projects, the damage of intellectual property rights and the low conversion rate of patents have become increasingly prominent. Therefore, we should strengthen the protection of personnel mobility and intellectual property rights in colleges and universities, realize the benefit balance between personnel mobility and intellectual property protection in colleges and universities, and establish a bidirectional supporting behavior model for personnel mobility and intellectual property protection in colleges and universities. It has become an important subject in colleges and universities. This paper first expounds the research background and significance of personnel mobility and intellectual property protection in colleges and universities, and further analyzes the purpose and innovation of the research on personnel mobility and intellectual property protection in colleges and universities. Then it describes the related concepts of intellectual property, management characteristics, loss channels and the dialectical relationship between them. Secondly, by analyzing the current situation of intellectual property protection in colleges and universities in China, the author points out a series of problems existing in the protection of intellectual property rights in colleges and universities in China. On the basis of the experience of intellectual property management in American and Japanese universities, the enlightenment of management consciousness, the ownership of intellectual property rights, the establishment and perfection of relevant policies and regulations are obtained. Finally, in the face of the problem of personnel mobility in domestic colleges and universities, this paper puts forward some corresponding measures and suggestions on how to protect intellectual property rights, including the awareness of intellectual property protection in colleges and universities, the construction of organizations, the rules and regulations, The internal management of mobile personnel and the introduction of "transfer system" and so on. In a word, this paper tries to resolve the disadvantageous factors of personnel mobility on intellectual property protection in order to promote the protection of intellectual property in colleges and universities.
