论法律援助立法完善

【摘要】：法律援助立法在实体上存在过分偏重经济标准、缺乏相关配套措施、资金不足、供需失衡等缺陷,在程序上存在申请程序单一、经济困难证明较随意、是否受理决定形式不明确等不足,这些缺陷和不足造成当事人的诸多权益得不到保障。应当采取降低法律援助门槛、扩大援助方式和范围、减免辅助费用、受援人适当分担部分费用等多个立法措施,真正为弱势群体提供必要的法律服务。
[Abstract]:There are some defects in the legislation of legal aid, such as excessive emphasis on economic standards, lack of relevant supporting measures, lack of funds, imbalance between supply and demand, and so on. There is a single application procedure in the procedure, and the economic difficulties prove to be more arbitrary. Whether or not the decision form is not clear and so on, these defects and deficiencies lead to a lot of rights and interests of the parties can not be protected. We should take several legislative measures such as lowering the threshold of legal aid expanding the aid form and scope reducing and abating the supplementary expenses and sharing part of the costs properly so as to provide the necessary legal services for the vulnerable groups.
