商业方法专利保护法律问题研究

【摘要】：经济的发展和科技的进步促进了商业的多样化进程,为了提高商业市场的竞争力,一些与科学技术相结合的商业方法开始作为发明申请专利,由此引发了一场关于商业方法专利保护的激烈探讨,并形成了对商业方法授予专利权的新的国际趋势。在这股潮流之中,虽然各国对于商业方法的可专利化的态度越来越趋近一致,但是有关商业方法的授权原则和专利的实质要件仍然没有统一和明确的规定。我国对商业方法专利保护的研究相较国外只有短短的几年时间,在立法层面上仍未明确肯定商业方法的可专利性,而在审查实践中虽已有金融商业方法获得专利授权但是仍然缺乏具体的专利实质要件的指引。本文通过对美国、日本和欧洲在商业方法专利保护制度和法规的分析,试图提出自己对完善商业方法专利化条件和保护制度上的观点。前言部分,简单介绍了商业方法的产生与发展以及目前与其相关的专利保护的态势,以求得到进一步思考。第一章则是概括的界定了与商业方法相关的概念内涵和解答了为什么要对商业方法进行专利保护的问题,为下面论述商业方法专利保护所要解决的问题做了理论上的基石铺垫。第二章是关于国外尤其是商业方法专利制度发展比较完善的美日欧在对商业方法进行专利权保护方面的经验教训。通过对三国在可专利性上和审查实质要件上的分析,以及各自利弊的探讨,由此得出域外对我国商业方法专利保护方面的启示。第三章是将视角转回到我国在授予商业方法专利权的过程中面临的立法和实践的困境,通过比较法律法规之间的规定,举例审查实践中申请权力的内容,尝试的来探讨我国在商业方法可专利主题和需要满足的法定条件方面存在的不足。最后一部分在以上三章的充分论证下,从法律层面试着提出解决我国商业方法专利保护存在的问题,提出完善专利制度的建议和对策,以期为那些质量高且有积极影响的商业方法科学获得专利权保护保驾护航。本文采用文献研究、比较分析、实证分析、总结归纳的研究方法,阐述了国外商业方法专利保护的基础理论。通过借鉴国外先进经验,分析我国商业方法专利保护的立法和实务现状以及存在的问题后,提出了健全相关法律制度的几点建议。
[Abstract]:Economic development and technological progress have promoted the process of diversification of business. In order to improve the competitiveness of the commercial market, a number of business methods combined with science and technology have begun to apply for patents as inventions. This led to a heated discussion on the patent protection of business methods, and formed a new international trend of granting patent rights to business methods. In this trend, although the attitude of various countries towards patentability of business methods is more and more consistent, there are still no uniform and clear regulations on the licensing principles and the essential requirements of patents. The research on the patent protection of commercial methods in our country is only a few years compared with foreign countries, and the patentability of commercial methods has not been clearly affirmed at the legislative level. In practice, though financial commercial methods have been granted patent authorization, they still lack the guidance of specific patent essentials. Based on the analysis of the patent protection system and regulations of business methods in the United States, Japan and Europe, this paper tries to put forward its own views on the improvement of the patent conditions and protection system of business methods. In the preface, it introduces the production and development of commercial methods and the situation of patent protection in order to get further thinking. The first chapter defines the connotation of the concept related to the business method and answers the question of why to protect the business method patent, which paves the way for the theoretical foundation stone of the following discussion on the problems to be solved in the patent protection of the business method. The second chapter is about the experience and lessons of patent protection of business methods in America, Japan and Europe, especially in foreign countries, especially in America, Japan and Europe. Based on the analysis of the patentability of the three countries and the examination of essential elements, as well as the discussion of their respective advantages and disadvantages, the enlightenment of the foreign countries to the patent protection of commercial methods in China is obtained. The third chapter is to turn the angle of view back to the dilemma of legislation and practice in the process of granting patent rights to business methods in our country. By comparing the provisions between laws and regulations, the author gives an example to examine the content of the application power in practice. This paper attempts to explore the shortcomings in the subject of patentability of business methods and the legal conditions that need to be met in our country. In the last part, under the full demonstration of the above three chapters, the author tries to solve the problems existing in the patent protection of commercial methods in China from the legal level, and puts forward some suggestions and countermeasures to perfect the patent system. In order to obtain patent protection for high-quality and positive business methods. In this paper, the basic theory of patent protection of foreign commercial methods is expounded by means of literature research, comparative analysis, empirical analysis and summing up the research methods. By referring to the advanced experience of foreign countries, this paper analyzes the current legislation and practice of patent protection of commercial methods in China and the existing problems, and puts forward some suggestions on how to perfect the relevant legal system.
