论贞操权在我国的法律实现

【摘要】：随着人类社会的发展,权利意识增强,人们越来越重视性利益的享有和捍卫,提出了贞操权概念,但审判实践中如何处理侵犯性利益的案件,贞操权是否为一项具体人格权,理论和实务都存在着争议。因此对贞操权进行研究,具有理论研究价值和实践指导意义。本文从一起贞操权案例产生的争议切入,首先解析贞操和贞操权的内涵,并提出笔者对贞操权内容的理解。同时对采用贞操权概念,还是性自主权概念进行分析,指出二者本质上的同一性,并辨析贞操权与其他人格权之间的关系。接着从人类社会的发展、人格权理论发展、各国或地区对贞操权独立保护的立法借鉴分析了贞操权存设基础。其后,对具体侵犯贞操权行为从刑法规制的角度进行了类型化分析。最后,本文立足我国人格权法定的立法实际,明确指出我国法官在法无明文规定的情况下,无权自行创设贞操权,就侵害贞操权行为提出了从“人格尊严权”和“其他人格利益”的角度来实现贞操权在我国的法律救济,为解决侵害性利益行为提供了一个新的视角。
[Abstract]:With the development of human society and the enhancement of consciousness of rights, people have paid more and more attention to the enjoyment and defense of sexual interests, and put forward the concept of the right of chastity. But whether the right of chastity is a specific personality right or not, there are disputes in theory and practice in the trial practice. Therefore, the study of the right to chastity has theoretical research. From the controversy of the case of the right of chastity, this article first analyzes the connotation of chastity and Zhen Caoquan, and puts forward the author's understanding of the content of the right of chastity. At the same time, it analyzes the concept of the right to chastity, or the concept of sexual autonomy, points out the identity of the two, and distinguishes the right of chastity and other personality. Then, from the development of human society, the development of the theory of personality right and the legislation of the independent protection of the right of chastity in various countries or regions, the foundation of the existence and establishment of the right of chastity is analyzed. After that, the specific infringement of the right to chastity is typed from the angle of criminal law. Finally, this article is based on the legislative practice of the legal personality of our country. It is clearly pointed out that the judges of our country have no right to create the right of chastity without the right to create their own chastity under the circumstances of the law without explicit law, and put forward the legal relief of the right of chastity in our country from the angle of "dignity and dignity" and "other personality interests" against Zhen Caoquan's behavior, providing a new angle of view for solving the infringing interests.
