不动产抵押物转让效力研究

【摘要】:担保交易整个过程中,抵押是重要的因素之一。在整个担保过程当中,抵押物转让是比较复杂问题之一,因为抵押物的转让会让抵押物的人们、抵押权人、抵押物接受的人们在处分权利、担保权益、物所有权之间发生矛盾、烦扰了市场交易的安全性和效率性。所以,怎样协调现有《物权法》有关精神保护这三大点的利益,成立一个有效的抵押物转让的规章体制,这是十分值得相关学者给予深刻的研究与分析。在抵押权追及效力、抵押物转让及三方当事人利益保护问题上,我国物权法等已有相关规定,但是不够全面,亦不尽合理。本文基于《民法通则意见》、《担保法》、《担保法解释》、《物权法》的相关规定进行分析,笔者对没有经过抵押权人允许的前提下转让抵押物效力大小予以探讨,指出我国关于不动产抵押物转让方面的不足,在此基础上,提出了确定允许抵押者转让抵押物、确立抵押权利追及的效力、赋予受让人涤除权和使登记体制的观点完整化。
[Abstract]:Mortgage is one of the important factors in the whole process of secured transaction. In the whole process of guaranty, the transfer of mortgage is one of the more complicated problems, because the transfer of mortgage will make the people of mortgage, mortgagee, and people accepting mortgage conflict between disposition rights, security interests and title to things. Disturbing the security and efficiency of market transactions. Therefore, how to coordinate the interests of the three points of spiritual protection and establish an effective system of rules and regulations on the transfer of collateral is worthy of profound research and analysis by relevant scholars. There are some relevant provisions in Chinese real right law, such as the pursuit and effect of mortgage, the transfer of mortgage and the protection of the interests of the three parties, but it is not comprehensive and reasonable. Based on the relevant provisions of the General principles of Civil Law, the interpretation of the Guaranty Law and the property Law, the author discusses the validity of the transfer of the mortgage without the permission of the mortgagee. This paper points out the deficiency of the transfer of immovable property mortgage in our country, on the basis of which, it puts forward the viewpoint that the mortgagor is allowed to transfer the mortgage, the validity of the mortgage right is established, the transferee is given the right to remove the right and the registration system is integrated.
