重构抑或调整:我国职务发明权属制度的困境及其破解

【摘要】:我国职务发明权属制度恪守"雇主优先"的模式使其在运行中遭遇诸多困境,主要表现为适用范围过于宽泛、权属约定契约化不足以及奖酬制度落实备受诟病。为此,新近立法动向对此进行了较为一致的有力回应,但理论界却一直存在三种不同的破解路径。基于理性的模式分析和现实的制度选择,重构模式下的赋予职务发明人专利申请权和建立职务发明共有制并不可取;而适当调整现行职务发明权属制度既具有内在合理性,也有实践角度的相当优势,理应得到认可。可通过合理界定适用范围、完善权利归属契约化以及加强奖酬制度的落实,来破解职务发明权属制度的运行困境,从而实现雇员和雇主利益的平衡。
[Abstract]:The mode of adhering to the "employer first" mode of tenure system of duty invention in our country makes it encounter many difficulties in its operation, which mainly shows that the scope of application is too broad, the contract of tenure agreement is insufficient, and the implementation of reward and reward system has been criticized. Therefore, the recent legislative trend has made a relatively consistent and effective response to this, but there have been three different ways of cracking in the theoretical circle. Based on rational mode analysis and realistic system selection, it is not advisable to grant the right of patent application to the duty inventor and to establish the system of co-ownership of the duty invention under the reconstruction mode, and the proper adjustment of the current ownership system of the duty invention has the inherent rationality. Also have the considerable advantage of practice angle, ought to get approbate. By reasonably defining the scope of application, perfecting the contract of ownership of rights and strengthening the implementation of the system of reward and remuneration, we can solve the operating dilemma of the tenure system of job inventions, thus realizing the balance between the interests of employees and employers.
