预购商品房抵押预告登记制度研究

【摘要】:预购商品房抵押预告登记是伴随着我国商品房预售制度兴起的一项配套制度,对控制银行住房贷款的风险、促进房地产市场的繁荣、满足购房人的融资需求发挥着至关重要的作用。然而对于如此重要、在期房买卖交易中运用如此普遍的一种登记方式,却仅出现在建设部颁布的《房屋登记办法》这一部门规章以及各省市出台《房地产登记条例》等地方性法规之中。就狭义的法律而言,目前尚缺乏对预购商品房抵押预告登记的直接规定。这直接导致了在司法实践中对预购商品房抵押预告登记的性质、效力理解不一,对银行能否据此对预购商品房行使抵押权这一预购商品房抵押登记纠纷的核心问题得出截然不同的裁判结论,呈现出司法严重不统一的现象。本文以一则预购商品房抵押预告登记纠纷的典型案例为切入点,从理论、立法、司法等不同维度对预购商品房抵押预告登记制度进行全方位的考量,探究我国现行预购商品房抵押预告登记制度的不足,并提出相应的立法完善建议,以期达到促成预购商品房抵押预告登记在司法上更趋统一,在立法上更臻完善之目的。除引言外,本文分为五个部分,共约2万字。第一部,据以研究的案例。本部分简要介绍了一则预购商品房抵押预告登记纠纷的典型案例,归纳了案例的争议焦点,引出本文拟探讨的预购商品房抵押预告登记的相关问题。第二部分,预购商品房抵押预告登记的理论考量。本部分主要对预购商品房抵押登记的概念、性质和意义等基础理论进行了探讨。第三部分,预购商品房抵押预告登记的立法考量。本部分主要从法律、部门规章、地方性法规三个层面上对关于预购商品房抵押预告登记的规定进行了梳理,并指出了预购商品房抵押预告登记在立法上存在的不足。第四部分,预购商品房抵押预告登记的司法考量。本部分主要对司实务中对于银行能否基于预购商品房抵押预告登记对预购商品房行使抵押权这一预购商品房抵押预告登记纠纷的核心问题的不同裁判观点进行了介绍,对各裁判观点及其理由进行了评析,并分析了预购商品房抵押预告登记的法律适用在司法实务中所呈现出来的问题。第五部分,预购商品抵押预告登记的立法完善。本部分对预购商品抵押预告登记制度的完善给出了立法上的建议。第六部分,结语。本部分对据以研究的案例进行了回顾,对全文进行了总结。
[Abstract]:Pre-purchase of commercial housing mortgage registration is accompanied by the rise of commercial housing pre-sale system in China a supporting system to control the risk of bank housing loans and promote the prosperity of the real estate market. Meeting the financing needs of home buyers is playing a vital role. However, for such an important use of such a common form of registration in futures transactions, However, only in the Ministry of Construction promulgated "Housing Registration measures" this department regulations and provinces and cities issued "Real Estate Registration regulations" and other local laws and regulations. In the narrow sense of law, there is still a lack of advance purchase of commercial housing mortgage registration of direct provisions. This directly leads to the nature of pre-purchase commercial housing mortgage pre-registration in judicial practice, the effect of which is not the same. Whether the bank can exercise the mortgage right on the basis of which the central issue of the mortgage registration dispute of pre-purchase commercial housing can be drawn a completely different conclusion, showing the phenomenon of serious judicial disunity. This article regards a typical case of pre-purchase commercial house mortgage registration dispute as the breakthrough point, from the theory, legislation, judicature and other different dimensions of pre-purchase commercial housing mortgage pre-registration system for all-round consideration. This paper probes into the deficiency of the current pre-purchase commercial house mortgage advance registration system in our country, and puts forward the corresponding legislative perfection suggestions, in order to achieve the goal of promoting the prepurchase commercial housing mortgage advance registration to be more unified in the judicature and perfect in the legislation. In addition to the introduction, this article is divided into five parts, a total of about 20, 000 words. The first part is a case study. This part briefly introduces a typical case of pre-purchase commercial housing mortgage registration dispute, summarizes the dispute focus of the case, and leads to the related problems of pre-purchase commercial housing mortgage pre-registration. The second part, the advance purchase of commercial housing mortgage registration theoretical considerations. This part mainly discusses the concept, nature and significance of mortgage registration of prepurchase commercial housing. The third part, the advance purchase of commercial housing mortgage registration legislative considerations. This part mainly from the law, department regulations, local laws and regulations on the pre-purchase of commercial housing mortgage registration of three levels of combing the provisions, and pointed out the pre-purchase of commercial housing mortgage notice registration in the legislation of the shortcomings. The fourth part, the advance purchase of commercial housing mortgage registration of judicial considerations. This part mainly introduces the different referees' viewpoints on whether banks can exercise mortgage right on the basis of pre-purchase commercial housing mortgage registration, which is the core issue of pre-purchase commercial housing mortgage registration dispute in practice. This paper analyzes the opinions of the judges and their reasons, and analyzes the problems of the application of the law in the judicial practice. The fifth part, the legislation consummation of advance purchase commodity mortgage advance registration. This part gives legislative suggestions on the improvement of advance-purchase commodity mortgage registration system. The sixth part, conclusion. This part reviews the case based on the study and summarizes the full text.
