因特网条约权利管理信息条款研究——兼论我国《著作权法》第三次修改

【摘要】：随着信息网络技术的不断发展,数字环境下的知识产权保护和执法逐渐成为一项重要的课题。1996年世界知识产权组织因特网条约对权利管理信息保护进行了专门规定,首次在国际法层面上要求各成员国对于权利管理信息提供适当和有效的法律救济。由于因特网条约仅提供了一个保护权利管理信息的基本框架,各成员国在很大程度上可以自由决定如何履行其国际法义务。比较各国履行因特网条约权利管理保护条款的国内立法,主要差异体现在权利管理信息定义、禁止行为、主观认知要求、例外限制情形以及法律救济方式五个方面。我国《著作权法第三次修改草案》在现行立法的基础上对权利管理信息提供了较为详尽合理的规定,但仍然存在一定不足有待明确。
[Abstract]:With the continuous development of information network technology, the protection and enforcement of intellectual property rights in the digital environment has gradually become an important issue. The 1996 World intellectual property Organization Internet Treaty provides for the protection of rights management information. For the first time in international law, member states are required to provide appropriate and effective legal remedies for rights management information. Since Internet treaties provide only a basic framework for the management of information on the protection of rights, member States are largely free to decide how to fulfil their obligations under international law. This paper compares the domestic legislation of various countries in implementing the provisions of Internet treaty rights management and protection. The main differences are reflected in five aspects: the definition of right management information, the prohibition of behavior, the subjective cognitive requirement, the exception restriction and the legal remedy. The third revision draft of copyright Law in China provides more detailed and reasonable provisions on the information of right management on the basis of current legislation, but there are still some shortcomings to be clarified.
