【摘要】:网络团购是随着互联网的发展新兴起来的一种消费方式,近年来发展迅速,其便捷、快速、优惠的特点为消费者带来了实实在在的利益。但与此同时,因为法律法规不健全、市场缺乏监督和管理、卖家不诚信等,消费者合法的利益屡屡遭到侵犯。鉴于此,本文从消费者权益保护的角度出发,剖析了当前侵害消费者权益的诸多表现,并结合我国现有的立法、行政、司法体系,提出了一些改进和完善的建议。本篇论文主要有四个部分:第一部分首先阐释了网络团购的概念,接着列举了现存的三种网络团购模式,并分析了网络团购相较于传统购物所体现出来的一些新特点;其次,结合当前比较主流的观点,着重分析了团购平台、卖家与消费者之间的关系。第二部分论述了团购中侵害消费者合法权益的诸多问题。本部分立足于网络团购的发展现状,从隐私权、知情权、安全保障权、公平交易权、求偿权等五个方面详细阐释了当前消费者权益保护中的突出问题。第三部分具体阐述了当前我国的立法保护现状、行政保护现状、司法保护现状,剖析了三个维度的优势和不足。第四部分是对策,结合前面三个部分的分析,从我国的国情出发,提出了很多有针对性的解决举措。
[Abstract]:With the development of the Internet, online group buying is a new consumption mode. In recent years, it has developed rapidly, and its characteristics of convenience, rapidity and preferential treatment have brought real benefits to consumers. But at the same time, due to imperfect laws and regulations, lack of supervision and management of the market, dishonesty of sellers and so on, the legitimate interests of consumers are repeatedly violated. In view of this, from the angle of consumer rights and interests protection, this paper analyzes many manifestations of infringing on consumers' rights and interests at present, and puts forward some suggestions for improvement and perfection combined with the existing legislation, administration and judicial system of our country. This thesis has four main parts: the first part explains the concept of online group purchase, then lists three existing online group buying models, and analyzes some new characteristics of network group purchase compared with traditional shopping; secondly, Combined with the current mainstream point of view, the analysis of group-buying platform, the relationship between sellers and consumers. The second part discusses many problems of infringing the legitimate rights and interests of consumers in group buying. This part is based on the status quo of the development of online group buying, from the privacy, the right to know, the right to security, the right to fair trade, the right to claim in detail to explain the current consumer rights and interests in the protection of outstanding issues. The third part elaborates the current situation of legislative protection, administrative protection and judicial protection in China, and analyzes the advantages and disadvantages of the three dimensions. The fourth part is the countermeasures, combined with the analysis of the first three parts, from the situation of our country, put forward a lot of targeted measures.
