剥夺与回归:我国未成年人监护权撤销制度的建构机理及其完善

【摘要】：监护权撤销制度的设立初衷在于以公权力介入来补私权自治的不足,以确保监护权的正确行使,维护未成年人的合法权益。制度设计本身内含着人伦向度上的回应。基于我国亲权与监护权混同的立法现状,本文的监护权撤销是对原始亲权有限度的剥离,即只有在穷尽其他救济手段无果时才能启动。监护权彰显的亲情家庭属性,使得我们的制度考量应该体现周全和圆整。为此应更多地关注监护权撤销前的干预监督及事后的判后安置,力求在合乎制度诉求价值底线前提下促成被撤销监护权的再度回归。
[Abstract]:The original intention of the revocation of custody system is to make up for the deficiency of private right autonomy by public power intervention to ensure the correct exercise of guardianship and to safeguard the lawful rights and interests of minors. The system design itself contains the response of the human relationship dimension. Based on the legislative situation of parental power and guardianship in our country, the revocation of guardianship in this paper is a limited stripping of the original parental right, that is, it can only be started when other remedies are exhausted. Custody of the family, so that our institutional considerations should reflect integrity and integrity. Therefore, more attention should be paid to the intervention supervision before the revocation of custody and the post-sentence placement, in order to promote the return of the revoked custody under the premise of meeting the bottom line of the system's claim value.
