论我国侵权法体系与责任保险的互动性

【摘要】：随着2009年《侵权责任法》的通过、实施,我国侵权责任法体系初步构建,侵权责任制度的确立；同时,我国大众市场逐步形成,社会风险达到前所未有的水平,责任保险方兴未艾。侵权责任制度的确立,对责任保险带来了机遇和挑战。责任保险依赖于侵权赔偿制度而存在,而侵权赔偿制度也无法忽视责任保险无时不在的影响。我国目前还处于责任保险的初步发展期,此时,观察国外已经运行了一个世纪多的责任保险制度,研究其与侵权责任制度之间互相渗透、互相影响、互相制约的共生关系及出现的种种问题,无论对于我国责任保险的健康发展,还是侵权责任制度的发展走向,都有着现实的借鉴意义。本论文在回顾我国侵权责任制度的构建过程、现状及特点,描述我国责任保险的发展情况的基础上,指出两者之间存在的共生关系,描述两者之间相互作用的实际情况,并分析在相互作用过程中产生的问题。通过介绍国外侵权责任法体系、责任保险之间互相影响、互动发展、互相制约以至于发展至今产生的所谓“危机”和困境的情况,论述侵权责任法体系与责任保险互相影响和渗透的原理,对“危机”进行深度解读；由此反观我国侵权责任法体系与责任保险的共生关系,对两者的良性发展提出可行性路径建议。本论文分五个部分进行论述,第一部分介绍了国外侵权责任制度的构建过程、现状及特点；第二部分介绍了国外责任保险的发展情况,从中体现出侵权责任法律制度对于责任保险的基础性作用,并介绍了我国责任保险发展的情况；第三部分重点论述责任保险对于侵权责任制度的影响,从正向影响和反向冲突两个方面进行论证。至此,本论文对于侵权责任制度与责任保险的共生关系阐述已较为详尽；第四部分,介绍了国外责任保险危机或曰侵权责任法危机的情况,并对这种危机的实质和根源进行了解读；最后,借鉴吸取国外的经验教训,提出侵权责任制度与责任保险良性发展、规避“危机”的可行性路径,笔者给出了六条建议。本论文的重点是研究侵权责任制度与责任保险的共生关系,目的是对我国侵权责任制度与责任保险如何实现良性发展提出建议。通过比较研究方法,以国外侵权责任制度和责任保险的发展情况为对象,研究两者是如何对对方施以影响,表现出哪些原理、规律,为我国侵权责任制度和责任保险的良性发展提供借鉴。
[Abstract]:With the adoption and implementation of the Tort liability Law in 2009, the system of tort liability law in our country was preliminarily constructed and the tort liability system was established. At the same time, the mass market of our country gradually formed, and the social risk reached an unprecedented level. Liability insurance is in the ascendant. The establishment of tort liability system brings opportunities and challenges to liability insurance. Liability insurance depends on tort compensation system, and tort compensation system can not ignore the influence of liability insurance. At present, our country is still in the initial stage of development of liability insurance. At this time, we have observed the liability insurance system which has been in operation for more than a century abroad, and studied the mutual penetration and mutual influence between it and the tort liability system. The symbiotic relationship of mutual restriction and various problems, whether for the healthy development of liability insurance in our country or the development trend of tort liability system, are of practical significance. On the basis of reviewing the construction process, current situation and characteristics of tort liability system in China, this paper describes the development of liability insurance in China, points out the symbiotic relationship between the two, and describes the actual situation of interaction between them. The problems in the process of interaction are analyzed. By introducing the foreign tort liability law system, the mutual influence, interaction and development of liability insurance, the so-called "crisis" and the predicament that have emerged from the development of mutual restriction so far are introduced. This paper discusses the principle of mutual influence and penetration between tort liability law system and liability insurance, and makes a deep interpretation of "crisis", and then reviews the symbiotic relationship between tort liability law system and liability insurance in China. Put forward the feasible path to the benign development of both. This paper is divided into five parts: the first part introduces the construction process, current situation and characteristics of foreign tort liability system, the second part introduces the development of foreign liability insurance. The third part focuses on the impact of liability insurance on the tort liability system, and introduces the development of liability insurance in China, the third part focuses on the impact of liability insurance on tort liability system, the third part focuses on the impact of liability insurance on tort liability system. From the positive impact and reverse conflict two aspects of the argument. So far, this paper has elaborated the symbiotic relationship between tort liability system and liability insurance in detail. The fourth part introduces the situation of foreign liability insurance crisis or tort liability law crisis. Finally, drawing lessons from foreign experiences and lessons, the author puts forward the feasible path of tort liability system and liability insurance to avoid "crisis", and gives six suggestions. The emphasis of this paper is to study the symbiotic relationship between tort liability system and liability insurance. The purpose of this paper is to put forward some suggestions on how to realize the benign development of tort liability system and liability insurance in China. Through the comparative research methods, taking the development of foreign tort liability system and liability insurance as the object, this paper studies how the two influence each other, what principles and laws are shown. It provides reference for the benign development of tort liability system and liability insurance in China.
