追续权的法律经济分析

【摘要】：我国著作权的修改草案中引入了追续权制度。追续权是指视觉艺术家在初次出卖自己作品后,其仍可分享作品之后的转卖中的价款。追续权作为一项旨在为视觉艺术家提供更多利益保护的权利,却从一开始就充满了质疑。追续权是否能够为视觉艺术家提供更多的经济利益的讨论经久不息,支持者认为追续权能够为视觉艺术家带来更多的经济利益,而反对者则认为实际上追续权并不能够达到这样的效果。除此之外,是否应当为视觉艺术家提供更多的保护也是充满着争议。追续权的支持者称视觉艺术家并未受到公平的对待,应当予以更多的保护。反对者则认为视觉艺术家已无需更多的保护。对于这样一项充满争议的制度,本文希望通过分析使得争议得到明晰,也能够为著作权的修改提供些许建议。本文主要分为四大部分,首先对前人关于追续权的研究予以梳理,包括追续权的起源、演变以及制度的设计等；之后对于追续权的权利属性进行分析,追续权属于人身权还是财产权也是学界具有争议的问题,而且追续权的权利属性会影响之后的经济分析,若追续权属于人身权,则即使其经济效果对于视觉艺术家来说是负面的,可能也仍值得建立这样的制度,因为对于视觉艺术家的人身提供了更多的保护；再则对于追续权的经济效果进行分析,主要运用经济学方面的知识进行理论分析,包括了追续权对于视觉艺术家、艺术品商人、一国拍卖市场的影响,还包括了追续权制度对于社会总体福利的影响；最后则对于视觉艺术家是否需要特殊保护的问题予以回答,因为视觉艺术家需要更多保护是追续权制度建立的前提,若这个前提不存在,追续权也没有建立的必要,而若确具有必要,即使追续权无法达到这个目的,可能也需要建立其他制度来保障视觉艺术家的权利。
[Abstract]:The amendment draft of copyright in our country introduces the system of the right of continuation. The right of continuation refers to the fact that the visual artist can still share the resale price after selling his work for the first time. As a right to provide more benefit protection for visual artists, the right of continuation has been full of doubts from the beginning. Whether the right of continuation can provide more economic benefits for the visual artists has been discussed for a long time. Supporters believe that the right of continuation can bring more economic benefits to the visual artists. Opponents, however, argue that, in practice, the right of renewal does not achieve such an effect. In addition, whether to provide more protection for visual artists is also controversial. Proponents of follow-up say visual artists are not treated fairly and should be given more protection. Opponents argue that visual artists no longer need more protection. For such a controversial system, this paper hopes to make the controversy clear through analysis, and can also provide some suggestions for the revision of copyright. This article is mainly divided into four parts, first of all, the previous research on the right to continue to comb, including the origin of the right to pursue, evolution and the design of the system; It is also a controversial issue in academic circles whether the right to pursue the right to continue belongs to the personal right or the property right, and the property of the right to pursue the right of continuation will affect the economic analysis after that, if the right to pursue the right of succession belongs to the right of the person, Even if its economic effect is negative for the visual artist, it may still be worth establishing such a system, because it provides more protection to the person of the visual artist; moreover, the economic effect of the right of succession is analyzed. It mainly uses the knowledge of economics to carry on the theoretical analysis, including the influence of the continuation right to the visual artist, the art dealer, the auction market of a country, and the influence of the continuation right system to the general welfare of the society; Finally, the question of whether visual artists need special protection is answered, because the need for more protection for visual artists is the prerequisite for the establishment of the system of the right of continuation. If this premise does not exist, there is no need to establish the right of continuation. And if it is necessary, even if the right of continuation can not achieve this goal, it may be necessary to establish other systems to protect the rights of visual artists.
