我国数字遗产继承问题的法律应对

【摘要】：伴随着网络科技快速发展,我们的物质生活和精神生活得到改善,由于数字遗产具有精神价值和财产价值,越来越多的人开始关注数字遗产。数字遗产继承所引发的纠纷也日益增加,由于法律并未对数字遗产进行规定,使得此类纠纷得不到有效解决,笔者将对数字遗产继承过程中出现的问题进行分析,并提出具体的法律应对措施。笔者将主要内容分为三章展开介绍:第一章,在对数字遗产的概念、特征、法律属性进行分析的基础上,重点论证了数字遗产继承的必要性和可行性。第二章,分析我国数字遗产继承面临的困境,并介绍了域外国家和地区的立法状况,指出其对我国立法的启示和可借鉴之处。第三章,对解决我国数字遗产继承问题提出了具体的法律应对措施。
[Abstract]:With the rapid development of network technology, our material life and spiritual life have been improved. Because digital heritage has spiritual value and property value, more and more people begin to pay attention to digital heritage. The disputes caused by the succession of digital estate are also increasing day by day. Because the law does not provide for the digital heritage, this kind of disputes can not be solved effectively. The author will analyze the problems in the process of the succession of digital estate. And put forward specific legal countermeasures. The author divides the main content into three chapters: the first chapter, on the basis of the analysis of the concept, characteristics and legal attributes of digital heritage, the necessity and feasibility of digital heritage inheritance are emphatically demonstrated. The second chapter analyzes the dilemma of digital heritage inheritance in China, and introduces the legislative situation of foreign countries and regions, and points out its enlightenment and reference to China's legislation. In the third chapter, the author puts forward specific legal measures to solve the problem of digital heritage inheritance in China.
