我国汽车消费者权益保护问题法理分析

【摘要】:我国汽车市场发展迅猛,汽车成为新的消费热点,在多重因素支持下,汽车正快速进入寻常百姓家庭,开始取代家电成为新一代的国民消费品。目前,我国的汽车产业呈现出规模庞大且增速逐年增高的趋势,但是,我国关于汽车消费者权益保护方面的法律法规和相关制度的建立及完善,与飞速发展的国内汽车市场相比存在一定滞后性,这种滞后性不可避免的暴露出我国汽车产业高速发展的情况下,汽车消费者权益保护方面存在法律缺位、立法质量不高等问题。这些问题一方面给汽车产业的发展埋下隐患,一方面使汽车消费者的个人权益无法得到有效保障。所以,对汽车消费者权益保护方面的法律问题进行研究刻不容缓且意义重大。任何一个强大的国家,都必须拥有强大的汽车产业,我国已经具备强大的工业生产能力,以及世界最大的汽车消费市场,所以要想把握好这个机遇,就需要我国的法律工作者对汽车消费者权益保护问题进行不遗余力的研究,尽可能好的完善相关立法。同时,近年来大量的汽车消费者投诉案件也反映出,在汽车消费市场存在诸多乱象,如何理清乱象,建立积极健康的汽车消费市场也是法律工作者亟待解决的事项。所以对于汽车消费者权益保护问题进行研究极有必要,宏观上可以有助于促进我国汽车产业的发展,微观上有助于规范我国汽车消费市场,保护汽车消费者的个人权益。本文主要采用了案例分析法、文献分析法和比较研究法进行研究,运用案例分析法总结并归纳我国汽车相关法律在实践上存在的问题,并以此为基础进行研究。运用文献分析的方法收集国内外汽车相关法律问题的研究成果,结合我的研究成果加以创新。运用比较研究的方法将国外的法律对策进行了比较分析,结合我国的汽车消费市场特点,得出可以借鉴、修改的经验。除此之外,本文还用历史分析法介绍了我国汽车产业发展沿革,进一步分析汽车相关法律问题的成因并以此为基础提出对策,不仅对具体法律进行深入解读,而且将主要精力放在立法思想的研究之上。本文共分五个部分。第一部分引言是对整篇文章所要分析的内容进行总体概括;第二部分对我国汽车消费者权益受到侵犯的现状进行深入说明;第三部分试图归纳我国汽车消费者权益难以得到有效保护的根本性原因;第四部分是文章的重点,根据上述得出的原因进行整理分析,得出汽车行业的相关立法要以保护汽车消费者利益为原则的结论。指出汽车行业的立法,要秉承依法治车而非依政策治车的思想,在独立的执法部门的执法下,尽最大可能保护汽车消费者的个人利益。主要是从完善现有法规、弥补立法空白等几方面提出对我国汽车市场法律的几点建议;第五部分作为结语,总结全文的行文思路。学术价值上看,本文对于当前我国汽车市场有客观清醒的认识,对汽车相关立法的完善做出有利的促进和补充。现实意义上说,通过归纳和研究研究我国汽车相关法律问题,为今后汽车产业发展以及汽车消费者维权方面提供可行的法律建议,同时为如何建立、健全规范的汽车市场的相关法律法规提供实用性建议,对于繁荣我国汽车消费市场,具有现实意义。
[Abstract]:With the rapid development of the automobile market in China, the automobile has become a new consumer hot spot. Under the support of multiple factors, the car is rapidly entering the common people's family and replacing the household appliances to become a new generation of consumer goods. At present, the automobile industry in our country is showing a large scale and increasing growth trend year by year. However, the rights and interests of the automobile consumers in our country The establishment and improvement of the laws and regulations and related systems of protection have a certain lag compared with the rapid development of the domestic automobile market. This hysteresis inevitably exposes the rapid development of the automobile industry in China. There are some problems in the protection of the rights and interests of automobile consumers, such as the lack of law and the quality of legislation. On the one hand, it is a hidden danger to the development of the automobile industry. On the one hand, the personal rights and interests of the automobile consumers can not be effectively guaranteed. Therefore, it is urgent and significant to study the legal problems of the protection of the rights and interests of the automobile consumers. The big industrial production capacity, and the world's largest automobile consumption market, so in order to grasp this opportunity, it is necessary for our legal workers to spare no effort to study the protection of the rights and interests of automobile consumers, and to perfect the relevant legislation as well as possible. At the same time, a large number of cases of automobile consumer complaints have also been reflected in recent years. There are a lot of chaos in the automobile consumption market. How to clear up the mess and establish a positive and healthy automobile consumption market is also an urgent matter for the law workers to solve. So it is necessary to study the protection of the rights and interests of the automobile consumers, and it can help to promote the development of the automobile industry in our country on the macro level, and it will help to standardize the steam in our country. The car consumer market protects the personal rights and interests of automobile consumers. This paper mainly uses case analysis, literature analysis and comparative research, and uses case analysis to summarize and summarize the problems existing in the practice of automobile related laws in China. The research results of automobile related legal issues are combined with the results of my research. By comparing the foreign legal countermeasures with comparative research methods and combining the characteristics of the automobile consumption market in our country, we can draw the experience that can be used for reference and modify. In addition, this paper also introduces the development of China's automobile industry by historical analysis. This paper further analyzes the causes of the relevant legal problems of automobile and puts forward the Countermeasures on this basis, not only to further interpret the specific law, but also to focus on the research of the legislative thought. This article is divided into five parts. The first part is a general summary of the contents of the whole article and the second part of the paper. The current situation of the rights and interests of automobile consumers in China is deeply explained. The third part tries to sum up the fundamental reasons why the rights and interests of the automobile consumers in China are difficult to be effectively protected; the fourth part is the focus of the article. According to the reasons mentioned above, the relevant legislation of the car industry should be taken to protect the automobile consumption. It is pointed out that the legislation of the automobile industry should uphold the idea of managing the car by law rather than the policy of managing the car according to the policy. Under the law enforcement of the independent law enforcement department, it is possible to protect the personal interests of the automobile consumers as much as possible. It is mainly from the aspects of perfecting the existing laws and regulations and making up for the legislative blank. The fifth part, as the conclusion, summarizes the line of thinking of the full text. In terms of academic value, this article will have an objective and sober understanding of the current automobile market in China, and make a favorable promotion and supplement to the perfection of the related legislation of the automobile. In the practical sense, through induction and research, the relevant legal problems of China's automobile are studied and studied for the future automobile. It is of practical significance to provide practical legal advice on the development of industry and the rights of automobile consumers, and to provide practical suggestions for how to establish and improve the relevant laws and regulations of the automobile market.
