职务作品著作权归属制度研究

【摘要】:作品作为人类文化的载体和结晶之一,一直被视为作者思想、情感的表达以及人格、智慧的体现。我国著作权法中规定的作品涵盖了自然人作品、职务作品、法人作品、委托作品及合作作品。在我国,著作权法往往倾向于保护作品的财力投入者而非创作者,未能发挥著作权本应具有的保护作者人格属性的作用,这在实际生产生活中非常不利于保护作者利益,不利于鼓励创作作品,也不利于优秀作品的产生。我国在规定职务作品的同时还规定了法人作品,两种作品在构成要件上的共通性太强,存在着一些交叉或冲突,造成了司法实践中难以区分的困境。本文基于职务作品著作权的相关基本理论,明晰界定了职务作品的概念和法律特征,在职务作品及相关作品间进行了辨识区分;然后梳理总结当前我国职务作品著作权归属制度存在的问题;再结合两大法系和国际条约中对职务作品著作权归属制度的立法实践,从而得出完善我国职务作品著作权归属制度的启示。本文正文部分主要分为以下四个部分:第一部分为“职务作品概念的界定”。比较不同国家、地区的职务作品涵义,并对职务作品的法律特征进行了整合,由此明晰界定了职务作品概念。第二部分为“我国职务作品著作权归属制度存在的问题”。在梳理、论述当前我国职务作品著作权归属制度现状及相关法律规定的基础上,整理和剖析我国职务作品著作权归属制度中存在的法律问题。第三部分为“职务作品著作权归属制度比较”。主要运用实证分析的方法对英美法系、大陆法系的国家、地区和国际条约中职务作品著作权归属制度的立法渊源和司法实践进行解析,得出启示。第四部分为“我国职务作品著作权归属制度的完善”。通过阐述把握著作权归属制度问题需要遵循的激励原则、利益平衡原则,提出完善我国职务作品著作权归属制度的建议。
[Abstract]:As the carrier and crystallization of human culture, the works have been regarded as the author's thought, the expression of emotion, and the embodiment of personality and wisdom. The works stipulated in the copyright law of China cover the works of natural people, job works, legal works, entrusted works and cooperative works. In our country, copyright law tends to protect the financial investment of the works. The entry, not the creator, can not play the role of the copyright protection of the author's personality, which is very bad for the protection of the author's interests in the actual production and life, is not conducive to encouraging the creation of the works, and is not conducive to the production of excellent works. There are some intersections or conflicts on the essentials, and there are some difficulties in the judicial practice. Based on the basic theory of the copyright of the job works, this paper clearly defines the concept and the legal characteristics of the job works, and makes a distinction between the job works and the related works, and then combs and summarizes the current China. The existing problems of the ownership system of the copyright of the job works; and then combining the legislative practice of the system of the ownership of the copyright of the job works in the two legal systems and international treaties, so as to draw the inspiration to improve the system of the ownership of the copyright of the job works in our country. The main part of this article is divided into the following four parts: the first part is the concept of "job works" Comparing the meaning of the job works in different countries and regions, and integrating the legal features of the job works, the concept of the job works is clearly defined. The second part is "the existing problems of the ownership system of the copyright works in our country". On the basis of the law, the legal problems in the system of ownership of copyright works in China are arranged and analyzed. The third part is "the comparison of the ownership system of the copyright of the job works". The main use of the empirical analysis method is to legislation of the copyright ownership system of the Office works in the Anglo American legal system, the national, regional and international treaties of the continental law system. The fourth part is "the perfection of the system of the ownership of copyright works in our country". Through the exposition of the incentive principles and the principle of interest balance, the suggestions for improving the ownership system of the copyright work in our country are put forward.
