著作权法语境中的“创作高度”批判

【摘要】:创作高度并非成文法概念,学理和判例中发展出的创作高度概念部分用来解读特定作品是否具有个性,部分用来区分作品与制品。实践中,部分判决是在质的意义上使用创作高度这一概念,部分判决是在量的意义上使用创作高度这一概念,都未明确指出创作高度的衡量标准。作品的原创性意指作者的创作行为创作出个性作品,强调的是作者的创作行为与作品之间的产出关系,并不评价创作成果是否满足特定标准。原创性是个有无问题,是个定性问题,而没有高低问题,并非定量问题。一般而言,只要存在创作自由,即可产生原创性成果。创造性、独特性、艺术价值、创作高度等都与作品是否满足原创性要求无关。
[Abstract]:The height of creation is not a concept of statutory law. The concept of height of creation developed in theory and jurisprudence is used to interpret whether a particular work has personality or not, and partly to distinguish between works and articles. In practice, some judgments use the concept of creation height in the sense of quality, and some judgments use the concept of creation height in the sense of quantity. The originality of a work means that the author's creative behavior creates a personal work, which emphasizes the output relationship between the author's creative behavior and the work, and does not evaluate whether the creation achievement meets the specific criteria. Originality is a question of whether there is a qualitative problem, not a matter of height or height, not a question of quantity. Generally speaking, as long as there is freedom to create, you can produce original results. Creativity, uniqueness, artistic value and creative height are all independent of whether the work meets the requirements of originality.
