地方政府推进不动产统一登记体系建设研究

【摘要】:不动产作为每一个人都会用到的东西,时至今日,已经不仅仅是我们所能“看得见,摸得着”的实物,而是变为与我们利益息息相关的不动产权能。随着我国市场化程度不断加深,越来越多的东西被投入到流通环节之中,实现商品化。与此不相适应的是,由于我国相关法律规定还不健全,给老百姓的日常交易带来了极大的不便。尤其是我国的不动产交易,已成为国民经济的重要组成部分,缺少一个统一的不动产登记体系,严重制约着我国的经济发展。因此,建设不动产统一登记体系的计划被我国政府提上日程。然而,正如我们所看到的,这个计划因为种种原因,遭到一再拖延。作为这个计划的具体落实者,地方政府难辞其咎。在这样的形势下,系统地梳理马克思土地产权理论与不动产登记制度在我国的发展历程,以及深入研究地方政府推进不动产统一登记体系建设的问题具有重要的理论和现实意义。 通过深入分析政府、市场和农村这三大因素与地方政府推进不动产统一登记体系建设的相互影响,,一是了解地方政府在推进这项工作的时候将会面临的问题。从政府自身角度来看,部门利益争夺、机构设置不合理、工作积极性不高、历史遗留问题、管理机制不健全是阻碍其开展工作的重要原因;从市场角度来看,只有投机分子会给政府工作制造麻烦;从农村角度来看,集体土地产权模糊以及土地流转方式不科学也会带来一定程度的负面影响。二是了解地方政府在推进这项工作的时候将会带来一系列可预见的益处。从政府自身角度来看,为不动产信息联网、征收房产税、建立公开透明的公务员财产申报制度都提供了极大的便利;从市场角度来看,更加安全的不动产交易平台、抑制房价过快上涨、摸清全国楼市情况有助于促进我国经济的良性发展;从农村角度来看,有助于加快农村土地改革,为农村土地流转提速。 针对以上问题,地方政府应当促进不动产登记机构整合,加快农村集体土地确权登记步伐以及实现不动产登记档案集约化管理,以推进不动产统一登记体系建设,为我国公民提供一个安全、自由的交易平台。
[Abstract]:Real estate, as a thing that everyone will use, is not only the object that we can "see and feel", but also the real estate power which is closely related to our interests. With the deepening of China's marketization, more and more things are put into circulation to realize commercialization. Because the relevant laws and regulations of our country are not perfect, it brings great inconvenience to the ordinary people's daily transaction. Especially the real estate transaction in our country has become an important part of the national economy. The lack of a unified real estate registration system seriously restricts the economic development of our country. Therefore, the plan of building a unified registration system of real estate has been put on the agenda by our government. However, as we have seen, the plan has been delayed for a variety of reasons. As the concrete implementers of the plan, the local government is to blame. In such a situation, systematically combing the development of Marx's land property right theory and real estate registration system in our country, And it is of great theoretical and practical significance to study the local government to promote the construction of the unified registration system of real estate. The interaction between these three factors, market and rural areas, and the promotion of the unified registration system of real estate by local governments is to understand the problems that local governments will face when they push forward this work. From the point of view of the government itself, competition for departmental interests, unreasonable setting of institutions, low enthusiasm for work, problems left over by history and inadequate management mechanisms are important reasons for hindering its work; from a market point of view, Only the speculators will cause trouble to the government; from the rural point of view, the ambiguity of collective land property rights and the unscientific way of land circulation will also bring some negative effects. Second, understand that local governments will bring a series of foreseeable benefits in advancing the work. From the point of view of the government itself, it has provided great convenience for the networking of real estate information, the collection of property taxes, and the establishment of an open and transparent civil servant property declaration system; from a market perspective, a more secure real estate trading platform, To curb the excessive rise in house prices and to find out the situation of the national property market will help to promote the benign development of our economy; from a rural perspective, it will help speed up the rural land reform and speed up the circulation of rural land. In view of the above problems, Local governments should promote the integration of real estate registration institutions, accelerate the registration of collective land rights in rural areas and realize the intensive management of real estate registration files, so as to promote the construction of the unified registration system of real estate and provide a security for Chinese citizens.
