物业服务合同纠纷中业主抗辩权探析

【摘要】:近年来,业主与物业服务企业之间的摩擦不断,随之而来的物业服务合同纠纷呈逐年上涨的趋势。物业服务合同是业主在物业服务合同纠纷中行使抗辩权的主要依据。业主抗辩权的正当行使有利于维护物业关系的稳定,促进市场经济秩序的健康发展。物业服务合同主要包括前期物业服务合同和普通的物业服务合同,这两类合同虽然在签订主体有所不同,但都是业主行使抗辩权的依据。同时,物业服务的持续性和不计量性特点决定了业主抗辩权不同于普通双务合同履行中的抗辩权,它的类型主要为同时履行抗辩权和不安抗辩权。虽然物业服务合同纠纷层出不穷,但通过亲自经历此类案件的审判实践,发现业主行使抗辩权的事由较为集中,这为研究业主抗辩权的现状提供了思路。本文重点结合物业服务合同纠纷具体案例,对业主在行使抗辩权过程中所存在的制度问题进行探讨,提出完善的意见和建议。笔者以B市某法院的六个案例为实证分析素材,根据业主行使抗辩权事由的不同对素材做分类并逐一探讨,通过分析业主抗辩权行使的现状,引发对当前制度的思考。在制度的完善上,立法制度方面,应尽快完善建设单位选聘物业服务企业制度,明确物业服务企业安全保障义务的范围、“业主”的范围、物业服务企业的服务标准;司法制度方面,应合理分配业主与物业服务企业之间的举证责任,同时也要完善物业服务合同纠纷解决机制。
[Abstract]:In recent years, the frictions between the owners and the property service enterprises have continued, and the concomitant disputes on the property service contract have been rising year by year. The property service contract is the main basis for the owners to make the right of defense in the disputes of the property service contract. The proper exercise of the right of defense of the owners is beneficial to the maintenance of the stability of the property relations and the promotion of the market economy. The property service contract mainly includes the early property service contract and the common property service contract. Although the two types of contracts are different in the signing subject, they are the basis for the owners to exercise the right of defense. At the same time, the continuity and the non measurement of the property service decide that the right of defense of the owner is different from the common double contract. The right of defense in the line is mainly to perform the right of defense and the right of displea. Although the disputes of the property service contract emerge in an endless stream, through the trial practice of this kind of case, it is found that the owner is more concentrated in the exercise of the right of defense. This provides a way of thinking for the study of the current situation of the right of defense of the owners. In the case of service contract disputes, the author probes into the institutional problems existing in the process of exercising the right of defense of the owners, and puts forward the perfect opinions and suggestions. The author takes six cases of a court of B as an empirical analysis material, classifies and discusses the material according to the differences of the owner's right to exercise the right of defense, and analyzes the right of defense of the owner by analyzing the rights of the owner. In the perfection of the system and the legislative system, we should improve the system of the establishment of the property service enterprise as soon as possible, clear the scope of the security obligations of the property service enterprises, the scope of the owners, the service standards of the property service enterprises, and the rational distribution of the proprietors and the judicial system. The burden of proof between property service enterprises and the dispute settlement mechanism of property service contracts should also be improved.
