专利申请人现有技术披露义务研究

【摘要】：在我国现行的专利法中,专利申请人有义务对专利审查部门披露专利相关的现有技术。但是,专利申请人现有技术披露义务在很多方面存在问题,无法从根本上规范专利申请人的行为。鉴于此,论文针对专利申请人现有技术披露义务负面影响进行分析,进而提出一些完善专利申请人现有技术披露义务的策略。
[Abstract]:In China's current patent law, patent applicants are obliged to disclose existing technologies related to patents to patent examination departments. However, the existing technical disclosure obligations of patent applicants have many problems, which can not fundamentally regulate the behavior of patent applicants. In view of this, the paper analyzes the negative effects of the existing technology disclosure obligations of patent applicants, and then puts forward some strategies to improve the existing technology disclosure obligations of patent applicants.
