快递服务损害赔偿法律问题研究

【摘要】:快递服务作为一种新兴产业极大的改变了人们的生活方式,与电子商务的完美衔接更是给人们带来了极大的便利。但是需要注意到,我国每年因快递服务损害造成的赔偿纠纷一直呈现上升趋势,除了快递服务本身基础设施不够完善的原因外,我国目前有关快递服务损害赔偿制度也存在立法缺失、效力层次不一的现状。各快递服务企业自行制定不同的损害赔偿标准,并且利用快递服务运单预先制定各种免责条款,使得快递服务消费者在遭受损失时很难获得满意赔偿。即使消费者就快递服务企业侵害事由诉至法院,却由于法律不够明确统一,各法院法官在行使自由裁量权时选择适用法律的不同导致出现同案不同判的结果,这些混乱使快递服务损害赔偿问题难以得到有效解决。为了解决这一难题,本文针对快递服务损害赔偿中的一些最容易引起争议的问题,如免责事由、保价限制性赔偿条款等进行研究,希望能够在今后的快递服务立法的修订中起到一定作用,最终达到维护消费者合法权益的目的。全文分为五个部分,主要包括以下几个方面:第一章对快递服务损害赔偿作了概述,并将快递服务与传统邮政普遍服务损害赔偿作了比较,以更加明确区分快递服务损害赔偿的特殊性。第二章阐述了我国快递服务损害赔偿的现实状况,包括当前快递服务损害赔偿的原因和基本类型。第三章对我国快递服务损害赔偿的立法现状进行了研究,包括现行有关快递服务损害的法律规范以及法律框架下的快递服务赔偿主体、举证责任分配、免责事由等问题。第四章全面分析了快递服务损害赔偿中的格式条款。从法律对一般格式条款的限制入手,分析了我国快递服务运单上有关快递服务损害赔偿的格式条款,并重点分析了保价与未保价限制性赔偿条款。第五章总结了我国快递服务损害赔偿存在的问题,并提出今后在立法中改进的建议,以期能够更好地维护消费者的合法权益。
[Abstract]:As a new industry, express service has greatly changed the way of people's life. The perfect connection with electronic commerce has brought great convenience to people. However, it should be noted that the compensation disputes caused by express service damage in our country have been on the rise every year, except that the infrastructure of express service itself is not perfect. In addition, there is a lack of legislation and different levels of effectiveness in the present compensation system for express service damage in our country. The express service enterprises make different compensation standards for damage, and make use of express service waybill to make various exemption clauses in advance so that the express service consumers are difficult to obtain satisfactory compensation in the case of loss. Even if the consumer appealed to the courier to appeal to the courthouse, but because the law was not clear enough, the judges of the court chose the difference of the applicable law when they exercised the discretion, which led to the result of the different cases of the same case. These confusion made it difficult to effectively solve the problem of damage compensation for express service. This paper, aiming at some of the most controversial issues in the damage compensation of express service, such as the disclaimer and the restrictive compensation clause, hopes to play a role in the revision of the future express service legislation and ultimately achieve the purpose of safeguarding the legitimate rights and interests of consumers. The full text is divided into five parts, mainly including The following aspects: the first chapter gives an overview of the damage compensation for express service, and compares the express service with the traditional postal service damage compensation, so as to make a clearer distinction between the particularity of the damage compensation for express service. The second chapter expounds the actual situation of the compensation for damage of express service in our country, including the damage compensation for the present express service. The third chapter studies the legislative status of the damage compensation for express service in our country, including the current legal norms of express service damage, the subject of express service compensation under the legal framework, the distribution of burden of proof, the disclaimer and so on. The fourth chapter analyzes the format of the damage compensation for Express service. From the limitation of the general form clause of the law, the article analyzes the formatted clauses of express service damage compensation on express service in our country, and focuses on the analysis of the insurance price and the uninsured restrictive compensation clause. The fifth chapter summarizes the problems existing in the damage compensation of express service in our country, and puts forward some suggestions for improving the legislation in the future. In order to better safeguard the legitimate rights and interests of consumers.
