论《民法典》对器官捐献自己决定权的规范回应

【摘要】：当自然人进行器官捐献的自我决定自由,被民法基本法的立法规范所承认时,即为器官捐献自己决定权。但囿于该权利的母权利——身体权在我国民法基本法范畴内的规范缺失,使得该权利无法得到民法基本法的承认和规范,进而导致该权利始终无法得到民事立法的全面保护。因此,在对现行立法守成和创新的基础上,借鉴域外立法的先进经验,在未来《民法典》身体权法律制度的框架内,对器官捐献自己决定权的主体、客体、内容和行使条件进行一般性规定,将为该权利的保护提供坚实的民法基础。
[Abstract]:When the natural person's freedom of self-determination of organ donation is recognized by the basic law of civil law, it is the right to decide organ donation. However, due to the lack of norms of the mother right, the right of body, in the basic law of civil law in our country, the right cannot be recognized and regulated by the basic law of civil law, which leads to the fact that the right is always unable to be fully protected by civil legislation. Therefore, on the basis of carrying out and innovating the current legislation, drawing lessons from the advanced experience of the extraterritorial legislation, and within the framework of the legal system of the body right of the Civil Code in the future, the subject and object of the right to decide on organ donation, A general regulation of the content and exercise conditions will provide a solid civil law basis for the protection of this right.
