网络虚拟财产的类型化与权利属性研究

【摘要】：当今时代信息技术飞速发展,互联网产业在许多国家的产业地位迅速上升,其对经济增长的贡献越来越大,互联网产业脱颖而出成为了人们备受关注的新兴事物。与此同时,互联网产业的高速发展带来的是有关网络虚拟财产的纠纷日益增多,如何合法高效地保护网络虚拟财产,维护广大网络用户的合法权益,促进互联网产业的健康发展已经成为我国理论界、实务界、网络产业界和众多网络用户的普遍关注。本文以我国对网络虚拟财产保护的现状和问题为出发点,归纳、比较国内学者们对网络虚拟财产权利属性的研究和主流学说,以国外及我国香港、台湾地区对网络虚拟财产的保护方式为借鉴,分析对网络虚拟财产类型化和分别界定为不同的权利属性的必要性和可行性,并阐述《民法总则》制定过程中关于网络虚拟财产规定的变迁,最终旨在落实对网络虚拟财产保护的具体路径和措施,将网络虚拟财产类型化并按不同的权利属性加以保护,希望对我国保护网络虚拟财产的民事立法问题能有所裨益。首先,对网络虚拟财产下定义并对其财产属性进行确定,并且归纳、分析了关于网络虚拟财产权利属性的几种主流学说,提出了对网络虚拟财产类型化区分的必要性。这是全文的理论前提和基础。其次,本文从立法方面出发介绍了我国网络虚拟财产民事立法保护的现状及当前时期我国在网络虚拟财产民法保护中存在的主要问题并对其进行仔细剖析。得出仅仅依靠我国现有的法律法规、行政规章、司法解释及相关行业的规定尚无法对网络虚拟财产提供明确、有效、完善的保护,应尽快在立法方面有所完善。然后细数了刚刚通过的《民法总则》对于网络虚拟财产规定的立法变迁,分析其不同规定各自的优劣。再次,对国外及我国香港、台湾地区网络虚拟财产民法保护的现状进行了介绍,得出上述国家及地区关于网络虚拟财产的民法保护方式虽然各不相同,且均还存在不完美之处,但是对于完善我国网络虚拟财产法律而言仍然是宝贵财富。属于对比借鉴部分。最后对网络虚拟财产类型化的区分标准提出自己的见解,并且重点分析了其各自的权利属性,以更好地保护网络虚拟财产。
[Abstract]:Nowadays, with the rapid development of information technology, the status of Internet industry in many countries is rising rapidly, and its contribution to economic growth is increasing. The Internet industry has become a new thing that people pay close attention to. At the same time, the rapid development of the Internet industry has brought more and more disputes about the network virtual property. How to protect the network virtual property legally and efficiently, and safeguard the legitimate rights and interests of the vast number of network users, To promote the healthy development of the Internet industry has become the general concern of our country's theoretical, practical, network industry and many network users. Based on the current situation and problems of virtual property protection in China, this paper summarizes and compares domestic scholars' research and mainstream theories on the property of network virtual property, taking Hong Kong, China and foreign countries as the starting point. This paper analyzes the necessity and feasibility of the types of network virtual property and the definition of different rights attributes in Taiwan, which are used for reference in the protection of network virtual property in Taiwan. This paper also expounds the changes of the regulations on network virtual property in the course of the formulation of the General principles of Civil Law, and finally aims at implementing the specific path and measures for the protection of network virtual property, and classifying the network virtual property and protecting it according to different rights attributes. It is hoped that it will be beneficial to the civil legislation of protecting the network virtual property in our country. First of all, define and determine the property attribute of network virtual property, and summarize, analyze several mainstream theories about network virtual property right attribute, and put forward the necessity of differentiating the type of network virtual property. This is the theoretical premise and basis of the full text. Secondly, this paper introduces the current situation of the civil protection of the virtual property in our country and the main problems existing in the civil law protection of the virtual property on the network in the current period, and makes a careful analysis of it. Only relying on the existing laws and regulations, administrative rules, judicial interpretation and related industry regulations can not provide clear, effective and perfect protection to the network virtual property, so we should improve the legislation as soon as possible. Then, the author analyzes the legislative changes of the regulations on virtual property in the newly adopted General principles of Civil Law, and analyzes the merits and demerits of the different regulations. Thirdly, this paper introduces the current situation of the civil law protection of the virtual property in China, Hong Kong and Taiwan, and draws the conclusion that the civil law protection methods of the virtual property in the above countries and regions are different, and there are still some imperfections in the civil law protection of the virtual property on the Internet. However, it is still a valuable asset to perfect the law of virtual property in our country. It belongs to the part of comparison and reference. Finally, it puts forward its own opinion on the classification standard of network virtual property, and analyzes their respective rights attributes in order to better protect the network virtual property.
