不动产预告登记效力研究

【摘要】:不动产预告登记制度隶属于物权法领域中的不动产登记制度,预告登记是不动产登记中不可或缺而又极其独特的一种登记类型。之所以特殊,原因在于其他类型的不动产登记一般都是将已经完成的不动产物权变动记载于册;然而预告登记所记载的并不是一项不动产物权,而是一项债权请求权,这项债权请求权在将来经过义务人的履行后会发生不动产物权变动的法律效果。预告登记赋予被登记的债权请求权以物权的某些效力,可以排除其后他人对不动产所实施的与权利人的请求权相抵触的处分行为,以确保将来能够顺利发生不动产物权变动的法律结果。换言之,预告登记并不能实现当下的经济利益,而是为日后发生的不动产物权变动提供一种保障。作为一种确保不动产物权变动切实发生的担保手段,预告登记具有自主性、临时性、附随性,并且兼具物权性和债权性。预告登记制度是不动产物权法领域中一项不可或缺的制度,最早出现在18世纪的普鲁士法中,《德国民法典》正式以法典的形式将该制度确立下来,后来世界上许多国家和地区如日本、我国台湾地区在制定相关法律时都对该制度予以采纳和承继。我国2007年颁布的《物权法》对不动产预告登记制度的适用范围、效力以及失效情形等方面作出了规定,这标志着这项重要的不动产登记制度在我国物权法领域的正式建立。效力问题是预告登记制度的核心问题,只有具备完整的、较强的效力,预告登记制度才能充分发挥其保障物权变动实现的功能。考察境外立法可知,在一些对不动产预告登记制度规定比较完善的国家和地区,如德国、日本,该项制度通常都具备保全权利、保全顺位以及破产保护的效力,并且对于预告登记后再处分行为的效力各国(地区)也有其不同的立法模式。我国《物权法》对预告登记的效力予以明确,即当事人双方申请了预告登记后,登记义务人在没有经过登记权利人同意的情况下,不得对登记不动产实施再次处分的行为,即使义务人实施了再次处分行为,该处分行为也不会导致物权变动。这条规定体现出了预告登记具有保全权利的效力,也可以说明,对于预告登记后再处分行为的效力我国立法采绝对无效原则。关于预告登记的其他效力,我国立法未予确认。可以看出,我国《物权法》仅用一个条文对预告登记的效力作出规定,显然比较简略,不够完善,不能充分发挥预告登记制度的功能,也不利不动产交易的繁荣发展。本文共分为四大部分,由五个章节组成。本文以发生在江苏省的一个司法案例作为切入点,引出我国不动产预告登记效力在实践操作中所存在的问题。本文的第一部分由两个章节组成,阐述不动产预告登记制度的基本理论,包括研究背景及意义、国内外学者的研究综述、不动产预告登记的内涵、性质、价值选择以及历史演变过程;第二部分主要对大陆法系国家的德国、日本以及我国台湾地区的不动产预告登记效力进行论述;第三部分主要介绍我国法律法规对预告登记效力的规定,并对我国的预告登记效力进行评析;第四部分,在借鉴其他国家经验的基础上结合我国目前的社会经济发展现状为我国建立更加全面系统的不动产预告登记效力体系提出相应建议。以期使我国的不动产预告登记制度更加全面、具体,具备可操作性,更好地发挥不动产预告登记制度保障交易安全的功能,促进我国不动产交易市场的繁荣发展。
[Abstract]:The system of real property registration is subordinate to the real property registration system in the field of real property law. The notice registration is an indispensable and extremely unique registration type in the registration of real estate. The reason is that other types of real property registration are generally recorded in the real property changes that have been completed; however, it is a preview. The registration is not a real property right, but a claim of claim. The claim will have the legal effect of the change of real property after the performance of the obligor in the future. The notice that the registration gives the right to the registered claim, with certain effect of the real right, can exclude the subsequent implementation of the real property. The action that contradict the right holder's claim is to ensure the legal result of the change of real property right in the future. In other words, the advance notice registration does not realize the current economic interests, but provides a guarantee for the change of real property right in the future. The pre registration system is an indispensable system in the field of real property law, which first appeared in the Prussian law in eighteenth Century, and the German Civil Code formally established the system in the form of code in the form of the code of law in eighteenth Century, and later many years in the world. The state and region, such as Japan, and the Taiwan region of our country adopt and inherit the system in the formulation of relevant laws. In 2007, the property law promulgated in our country stipulates the scope, effectiveness and failure situation of the registration system of real property preview, which marks the important real property registration system in China's property law. The issue of validity is the core of the notice registration system. Only with a complete and strong effect, the pre registration system can give full play to its function of ensuring the realization of the change in property rights. The system usually has the effectiveness of preserving the rights, preserving the order and the bankruptcy protection, and there are different legislative modes for the effective countries (regions) of the action after the announcement of the registration. In the case of the consent of the registrant, no further disposition of the registered real estate shall be carried out. Even if the obligor has carried out the action again, the action will not lead to a change in property rights. This provision embodies the effect of the pre registration registration with the protection of the right, and may also indicate that the act of dispose of the registration after the registration is made. As to the principle of absolute invalidity in China's legislation, the legislation of our country has not been confirmed on the other effects of the registration of pre registration. It can be seen that the property law of China stipulates only one provision on the validity of the notice registration. It is obviously relatively simple, not perfect, and can not give full play to the function of the advance notice system and the prosperity of the real estate transaction. This article is divided into four parts. This article is composed of five chapters. This article, taking a judicial case in Jiangsu as a breakthrough point, leads to the problems in the practice of the validity of the registration of real estate in China. The first part of this article is composed of two chapters, and expounds the basic theory of the system of the real estate notice registration, including the research. The background and significance, the domestic and foreign scholars' research summary, the connotation, nature, value choice and historical evolution process of the real estate forecast registration; the second part mainly discusses the registration validity of the real estate forecast in the German, Japanese and Taiwan regions of the continental law system; the third part mainly introduces the laws and regulations of our country to the advance notice. On the basis of the experience of other countries and the present situation of our country's social and economic development, the fourth part puts forward some suggestions for the establishment of a more comprehensive and systematic system of the validity of the registration of real estate in our country on the basis of the experience of other countries. Comprehensive, specific, operable, better use of the real estate notice registration system to protect the security of the transaction, and promote the prosperity and development of the real estate market in China.
