商标侵权中“商标使用”的认定

【摘要】："商标使用"是指将标志用来识别和区分商品或服务来源的行为。要认定商标侵权行为,首先需要判断被诉标志的使用是否构成"商标使用",但商标使用的认定在我国商标法理论和实践中争议颇多。根据符号学和消费者心理学的理论,认定"商标使用"应当结合个案事实考察标志符号的表现形式、消费者与符号的接触过程两个方面。在具体判断中,尤其要关注标志符号的识别强度,包括符号的显著性和知名度;关注消费者主体所处的环境,包括被诉侵权者的具体符号使用方式,其对消费者注意力的影响等。
[Abstract]:Trademark use refers to the use of a mark to identify and distinguish between the sources of goods or services. In order to identify trademark infringement, it is necessary to judge whether the use of the trademark is "trademark use" or not, but the determination of trademark use is controversial in the theory and practice of trademark law in our country. According to the theory of semiotics and consumer psychology, it is concluded that the use of trademark should be combined with the facts of individual cases to examine the manifestation of the symbol and the contact process between the consumer and the symbol. In the specific judgment, we should pay particular attention to the identification intensity of the symbol, including the significance and popularity of the symbol, the environment in which the consumer is in, including the specific way of using the symbol of the accused infringer, Its influence on the attention of consumers, etc.
