音乐作品使用授权问题研究

【摘要】：在著作权法保护的作品类型中,音乐作品是比较具有代表性的一类。随着商业模式的发展和传播技术的进步,音乐作品的传播方式及其保护问题变得越来越复杂。一方面,对于著作权人而言,虽因创作作品而享有权利,却往往无法有效实现和保护其利益。另一方面,对使用者而言,因不能便利或者没有取得授权而不能合法利用作品。有鉴于此,本文从卡拉OK音乐版权诉讼为视角,研究我国音乐作品的使用授权现状和问题,并借鉴国外的音乐作品使用授权的模式和先进经验,从集体管理组织的管理创新和制度创新以及著作权人的自主许可模式的创新等方面,探讨解决我国音乐作品的合法使用授权问题。
[Abstract]:Among the types of works protected by copyright law, musical works are more representative. With the development of business model and the progress of communication technology, the communication mode and protection of musical works become more and more complicated. On the one hand, for copyright owners, although they have the right to create works, they are often unable to effectively realize and protect their interests. On the other hand, users cannot use the work legally because it is not convenient or authorized. In view of this, from the perspective of karaoke music copyright litigation, this paper studies the current situation and problems of the licensing of music works in our country, and draws lessons from the mode and advanced experience of foreign music works licensing. From the aspects of management innovation and system innovation of collective management organization and the innovation of copyright owner's independent licensing mode, this paper discusses how to solve the problem of legal use authorization of music works in our country.
