我国不动产登记的审查标准研究

【摘要】:登记审查是整个不动产登记制度的核心内容之一,但就不动产登记的审查标准或方式而言,现行的《中华人民共和国物权法》以及2015年3月1日刚施行的《不动产登记暂行条例》等法律法规对其均无作出明确、详尽的界定,因此,关于不动产登记审查标准的问题在理论上、立法上和实践中目前尚无统一的认识,存在着实质审查与形式审查之争。由于对审查标准认识不一致,各地区登记机构在办理不动产登记过程中,难免会发生相同业务却出现完全相反的办理结果,导致登记机构与民事主体之间就能否办理登记产生剧烈矛盾;而司法机关与登记机构对登记标准认识的不一致,更是使登记机构工作人员面临因审查不到位而被追责和被要求赔偿的法律风险,登记机构工作人员因此过度审查的现象也屡有发生,基于此,我们有必要对我国不动产登记的审查标准进行明确和完善。本文分为七章:第一章导论,主要是提出问题、说明研究方法和思路,重点论述研究本选题的意义。第二章,对不动产登记制度进行概述。第三章,主要是对不动产登记审查标准的两种理论模式进行梳理。第二和第三章内容为理论知识介绍,是下文的理论基础。第四章,为本文的重点章节之一,笔者针对我国不动产登记审查标准的立法现状详细分析了我国不动产登记的立法现状、立法问题以及各界人士对我国不动产登记审查标准所持的观点和依据。第五章,为本文的重中之重,该部分以深圳等城市的具体做法和实际案例作为素材,详细论证了我国不动产登记审查标准不明确所引发的区域矛盾和部门矛盾,进而探讨在具体实务操作中,如何从登记的申请主体、客体及其内容等方面来完善我国不动产登记的审查标准,以及如何判定不动产登记机构是否已尽合理审慎职责。第六章也是重点内容,点出我国不动产登记审查标准实施中应注意的问题,相关问题的解决对完善后的不动产登记审查标准的顺利落实影响重大。第七章为结论。纵观全文,笔者始终注重法律的实效性,因此,笔者并不局限从物权保护的角度进行论述。而是,从目的论的角度出发,通过分析得出我国的不动产登记审查标准应该根据物权法律关系的要素(登记主体、登记客体、登记内容)分项审查,在形式审查的过程中应严格完成审查的各项程序和充分利用现有技术手段;而在实质审查过程中则应穷尽手段以排除合理怀疑,确保登记的正确性。
[Abstract]:Registration and examination is one of the core contents of the whole real estate registration system. However, as far as the examination standards or methods of real estate registration are concerned, the current Real Right Law of the People's Republic of China and the Provisional Regulations on Real Estate Registration, which just came into effect on March 1, 2015, do not have a clear and detailed definition. Therefore, there is no clear and detailed definition about real estate registration. In theory, there is no uniform understanding of the criteria for examination of registration in legislation and practice, and there is a dispute between substantive examination and formal examination. There is a sharp contradiction between the registry and the civil subject, and the inconsistency between the judicial organ and the registry in understanding the registration standards makes the registry staff face the legal risk of being prosecuted and compensated for the lack of examination. The phenomenon of over-examination by the registry staff is also common. This article is divided into seven chapters: Chapter one is the introduction, which mainly puts forward the problems, explains the research methods and ideas, and focuses on the significance of this topic. Chapter two, the real estate registration system is summarized. Chapter three, mainly on the real estate registration. The second and third chapters are the introduction of theoretical knowledge, which is the theoretical basis of the following. Chapter four is one of the key chapters of this paper. The author analyzes the current legislative situation, legislative problems and various circles of real estate registration in China in detail. Chapter five is the most important part of this paper. This part takes the concrete practices and actual cases of Shenzhen and other cities as the material, demonstrates in detail the regional contradictions and departmental contradictions caused by the unclear examination standards of real estate registration in China, and then discusses the specific practice. How to perfect the examination standard of real estate registration in China from the aspects of application subject, object and content, and how to judge whether the real estate registration institution has done its reasonable and prudent duty. Chapter 7 is the conclusion. Throughout the full text, the author always pays attention to the effectiveness of the law. Therefore, the author does not confine himself to the protection of property rights. Instead, from the perspective of teleology, the author draws the conclusion that the real estate registration examination standards should be rooted in China. According to the elements of the legal relationship of real right (registration subject, registration object, registration content), the procedure of examination should be strictly completed and the existing technical means should be fully utilized in the process of formal examination, while in the process of substantive examination, the means should be exhausted to eliminate reasonable doubt and ensure the correctness of registration.
