中国城市住宅建设用地使用权自动续期研究

【摘要】:《中共中央国务院关于完善产权保护制度依法保护产权意见》于2016年11月27日正式对外发布,这是我国首次以中央名义出台的产权保护顶层设计,《意见》明确规定,研究住宅建设用地等土地使用权到期后的法律安排,这标志着我国城市住宅型建设用地使用权以何种方法自动续期已是一个急需解决的问题。城市住宅型建设用地使用权续期问题的妥善解决既牵动着国家产权保护顶层设计,同时也关乎到每一个城市住宅类建设用地使用权人的切身利益。在住宅建设用地等土地使用权到期后的法律安排呼之欲出之际,本文首先运用文献分析法,对我国城市建设用地使用权期限不同时代立法规定的变化和不同学者对建设用地使用权届满自动续期的观点进行梳理,阐释我国立法者对城市建设用地使用权期限规定的立法目的。接着运用案例分析法对青岛、温州两个建设用地使用权撞限的住宅物业的实际解决方案进行分析,从中找到当地对城市建设用地使用期续期问题解决的不合理处、同《物权法》中对城市建设用地使用权续期的立法本意相违背之处,同时提出急需妥善解决的关键点。最后本文运用比较分析法通过对德国、日本、中国台湾、英国、中国香港住宅产权续期的实际方案进行分析,在权衡其中各种利弊后,提出适合我国国情并也符合《物权法》中关于城市建设用地使用权自动续期立法本意的建议。
[Abstract]:The "opinions of the CPC Central Committee and the State Council on perfecting the system of property right Protection in accordance with the Law" was officially issued to the public on November 27, 2016. This is the first top-level design for property rights protection in the name of the central government in China. This paper studies the legal arrangement after the expiration of land use right such as residential construction land, which indicates that the method of automatic renewal of urban residential construction land use right in China is an urgent problem to be solved. The proper solution to the renewal of the right to use urban residential construction land not only affects the top-level design of national property right protection, but also relates to the vital interests of every person who uses urban residential construction land. When the legal arrangement after the expiration of land use right, such as residential construction land, this paper first uses the literature analysis method. This paper combs the changes of the legislative provisions in different times of the term of the right to use urban construction land in China and the views of different scholars on the automatic renewal of the right to the use of construction land. The legislative purpose of legislator on the term of the right to use urban construction land is explained. Then using the case analysis method to analyze the actual solution of the residential property which is limited by the right to use the construction land in Qingdao and Wenzhou, and find out the unreasonable solution to the renewal problem of the urban construction land use period. It is contrary to the original legislative intention of the renewal of the right to use urban construction land in the Real right Law, and puts forward the key points that need to be solved properly at the same time. Finally, this paper uses comparative analysis method to analyze the actual plan of renewal of residential property right in Germany, Japan, Taiwan, Britain and Hong Kong, China. After weighing the advantages and disadvantages, This paper puts forward some suggestions on the legislative intention of automatic renewal of the right to use urban construction land, which is suitable for the national conditions of our country and is also in line with the original legislative intent of the right to use urban construction land.
