论网络环境下的著作权默示许可制度

【摘要】：著作权默示许可制度是以效率原则和信任理论为支撑的。该制度具有以默示方式为意思表示、以默示的方式成立许可使用合同和适用于网络环境的特征。我国虽然已经有相关法律规定,但还十分不完备,需要借鉴国外相关经验,从适用范围、构成要件和著作权人权利保障等方面构建我国的著作权默示许可制度。
[Abstract]:Copyright implied license system is supported by efficiency principle and trust theory. The system has the characteristics of implied means, implied form of licensing contract and applicable to the network environment. Although our country already has the related law stipulation, but also is not complete, needs to draw lessons from the foreign related experience, constructs our country copyright implied license system from the application scope, the constitution element and the copyright owner's right safeguard and so on.
