贵阳市花溪区宅基地使用权流转问题研究

【摘要】:一块宅基地,其上附加的权利具有多样性和多重性,包括集体土地所有权、宅基地所有权和使用权、农民住房所有权、农民居住权等,因不同的权利涉及不同的主体,所以农村宅基地使用权流转就会涉及到流转利益在不同的主体之间的合理分配问题,又因为我国正处于破除城乡二元结构、加快实现城镇化的历史阶段,所涉及的利益诉求更复杂和多元,更加剧了宅基地使用权改革和现代流转制度构建的困难性。本文通过对调查材料的分析研究,找出花溪区宅基地使用权流转中最突出的问题并提出适当的解决方法和建议,以期更加完善的花溪区宅基地使用权流转制度的建立,为提高农村土地利用率、增加农民财产性收益提供制度保障。本文主要分为四部分。第一部分是绪论,主要就本文的研究背景及意义、研究现状、宅基地使用权相关概念的理解进行阐述。本文的研究处于我国破除城乡二元结构、深化农村土地制度改革的大背景下,符合社会经济发展现状,有利于提高花溪区农村宅基地利用率、增加花溪区农民财产性收益。对现行理论研究与法律政策的梳理加深了笔者对宅基地制度的认知,为更好地完成论文提供了帮助。只有充分了解宅基地制度的历史变迁过程,才能更好地理解我国宅基地使用权的内涵和特征,本部分是本文能够顺利完成的前提。本文第二部分简单阐述了调查的基本情况,通过对花溪区法院案卷的调阅、对花溪区部分村寨的问卷调查及对花溪区基层工作人员的访谈,掌握了关于花溪区宅基地使用权流转情况的丰富材料,是完成本文的基础。本文第三部分是本文的重点部分,该部分分别就花溪区宅基地使用权在初始流转、再次流转、纠纷解决中遇到的问题及相关建议进行了详细阐述。提倡初始取得的有偿性,通过建设农村公寓来改善宅基地不足的现状,坚持审慎、逐步、适度放开宅基地流转的态度,加强对宅基地的管理,完善宅基地纠纷司法解决方法。本文第四部分是结语,就花溪区宅基地使用权流转问题进行总结。
[Abstract]:The rights attached to a homestead have diversity and multiplicity, including collective land ownership, homestead ownership and use right, peasant housing ownership, peasant residence right, etc., because different rights involve different subjects. Therefore, the circulation of the right to use the rural homestead will involve the rational distribution of the interests of the circulation among different subjects, and because our country is in the historical stage of breaking down the dual structure between urban and rural areas and speeding up the realization of urbanization. The interests involved are more complex and pluralistic, which aggravate the difficulty of the reform of the right to use the homestead and the construction of the modern circulation system. Through the analysis and study of the investigation materials, this paper finds out the most prominent problems in the circulation of the right to use the homestead in Huaxi District, and puts forward appropriate solutions and suggestions, with a view to establishing a more perfect circulation system of the right to use the homestead in Huaxi District. In order to improve the utilization rate of rural land, increase farmers property benefits to provide institutional protection. This paper is divided into four parts. The first part is the introduction, mainly on the background and significance of this paper, research status, the understanding of the concept of homestead use right. Under the background of our country breaking out the dual structure of urban and rural areas and deepening the reform of rural land system, the research in this paper is in line with the present situation of social and economic development, which is conducive to improving the utilization rate of rural homestead in Huaxi District and increasing the property income of farmers in Huaxi District. Combing the current theoretical research and legal policy has deepened the author's understanding of the homestead system and provided help for the better completion of the thesis. Only by fully understanding the historical change process of the homestead system can we better understand the connotation and characteristics of the right to use the homestead in our country. This part is the premise of the successful completion of this article. The second part of this paper briefly describes the basic situation of the investigation, through the case files of Huaxi District Court, a questionnaire survey of some villages in Huaxi District and interviews with grass-roots staff in Huaxi District. It is the foundation of this paper to master the rich materials about the circulation of homestead use right in Huaxi District. The third part of this paper is the key part of this paper, this part of the Huaxi residential land use right in the initial circulation, circulation again, dispute resolution encountered problems and related suggestions are described in detail. We should advocate the paid nature of the initial acquisition, improve the status quo of the lack of homestead through the construction of rural apartments, adhere to prudence, step by step, and appropriately open the attitude of homestead circulation, strengthen the management of the homestead, and improve the judicial solution to the disputes over the Homestead. The fourth part of this paper is the conclusion, on the Huaxi residential land use right circulation issues are summarized.
